my husband and i were married in chicago in 2002. we have since moved to NYC and did not begin the process for his GC until last year. things moved quickly and our case has been approved and he is due to recieve his green card this month. sadly, we have been seperated since november of last year and are planning to get divorced. i really don't want this to interfere with his status- does anyone know if there is any time limit after one recieves one's gc that we can get divorced without it affecting him? does it make a difference if i'm the one asking for divorce being the US citizen?

It is my understanding that he initially gets a conditional green card. After a certain period (I believe 1 year) once he presents proof that you have continued to get married and are still together, the condition is removed from his GC. This was introduced to prevent fraud in cases where individuals got "married" very briefly just for the sake of getting a GC. There are possibly exceptions to it. Have your husband consult an attorney.
