Hi

I just got my EAD but we are having some problem with our marriage. I just want to ask if we divorce, then will my EAD be cancelled automatically or else what will happen and what I need to do?

Reponses will be highlly appreciated.

Hi. Sorry to hear about your situation. Here are my 2 cents. If you get divorced and your spouse withdraws the AOS application, your EAD/AP is cancelled and you are immediately out of status (unless you are on a valid/unexpired non-immigrant visa and have not used your EAD).

Sorry for your situation, but for how long you have been married? Many marriages in early stages suffer from communication to adaptation and that is normal.

What Ari4u said is true. Plus when the time of your interview comes you have to show that your marriage is/was bona fide.

Good luck,

Again, sorry for that kind of thing happen to you. However, you still have the path that a lot of lawyers use it for their last resource. Try to read this and see if it fit to your situation or not. If it really fit, you might need some assistance from a lawyer. Here is the link

It's about some U.S. citizens and LPRs misuse their control of AOS process to abuse their family members, or by threatening to report them to the USCIS. Therefore, you may self-petition to obtain lawful permanent residency.

BTW, I assume that you file I-485 base on C-9 category. Hope you guys solve this matter with peace and end with happiness.

I found your same thread in the EAD and Advance Parole.

"Hi, I am married to a USC in February. filed for EAD and Adjustment of status. I got my EAD recently and recieved interview date which is in september 2005. But we are having problems and its going to end up in divorce. I really need some expert advice on what will be my position in that case. Do i have to go back to my country / is there a way I can fight my own case. This was all unexpected but we have no choice. Please suggest me something, I am very confused.

Thank you in advance
Ravi"

I don't read anything about being abuse in here. What means with "we have no choice"? As I said before, is normal to have discrepancies and stuff like that in your marriage, all marriages but in this forum more and more I just heard about how people get worry about their green card process than their own marriage, which looks like it wasn't bona fide. Now I am not judging you (I am speaking in general) and this is not a marriage forum, I am agree with that but the law is pretty clear on marriage to a USC.

Good luck,
