Discrepancy of dates ..do the math... HELP!!

Ok, here it is my case..could someone help me out to figure this out.

I am 30 yrs old. Son of US citizen, mom is naturalized US citizen; stepdad is US Citizen.

My stepdad applied for me for permanent residency in August 1994, I was 22 at that time. I received approved notice few months later, then processed my papers, got my work permit in 1995, all was good until I had the interview in 1995. They denied me everything because INS made a math mistake and I fell under a different category. They thought I was 18 years old when my stepdad married my mom . It turned out that I was 19 yrs old when they got married and INS did the math in the interview and they said because of that I would fall under a different category, therefore, I was denied all of privileges of a "child". How true is that? In my case to become eligible for immediate visa does the law says that I must be under 18 or under 21 yrs of age to have immediately visa availability? I was 19 yrs when I became stepson of my stepdad.


- I was born in Aug 1972 in Mexico

- I entered the US in 1994, I was 22 years old.

- My stepdad married my mom in May 1992. (I was 19 yrs then)

- My dad applied for me in 1994, I was 22 then.

- Would I have any chance to have immidiate visa privilege?

- They issue a deportation order against me in 1995 when they denied me all of that becasue of the math mistake they made in the first place, 1 yr made the difference. But the deportation was stopped when my mom became a citizen in 1995 and she applied for me, but now I have to wait until my priority date, which is Oct 1995, falls through to get a work permit. I dont' have a permit yet and I am still waiting. INS is processing fam based visa category 1 (my category) but with date March 1992, mine is Oct 1995.

I live in the US and I don't know yet what to do. I am unmarried. I have a degree and have lost many, many job opportunities because I don't have the permit yet.

is there any law that will help me to get at least a work permit?

I heard that in June 2002 the child Status Protection Law passed, would that help me to get my permit under my stepdad's application?. I was 19 yrs of age when my stepdad married my mom. he applied for me when I was 22.

Any hope?? I am gettig desperate and the wait is gettting longer....

please help!!
