Discouraged when just start preparing for NIW at NSC!

I have planed to apply NIW at the end of last year and am starting to write the draft of the recommendation letters. But now feel discouraged after searching for evidence for I-140 application

First, I am confindent that my background fits NIW first two progs and I know quite a few professors, then if I could get recommendation letters (Rls) from them, I should have big chance to get my application of I-140 approved.

After two weeks, esp. after I read the released rejected sample cases (for public) from NSC website, I feel discouraged! i don't know how to draft a good RLs and don't know how to demonstrate I am excellent in front of the picky immigration officer in NSC. It seems it is not good enough for them to approve the alien's I-140 even the alien got approved patents, got papers publishe (some even has 16 papers), got request for reprints, reviewed papers, got serveral citations from his papers, got big person to write the RLs. But why such evidences were not good enough?

Outside of US, I got my Ph.D out of US. and had an approved patent from my own country and 4 non-English papers without many citation. Co-authered book chapters of 3 non-english books

In US, my research only resulted in 2 English peer-viewed paper got accepted, but not in press yet (although I am still preparing for antoher one). So I cannot get any citation from those 2 papers. I reviewed papers twice and have 3 membership with one by invitation. 4 Egnlish Abstract. That's all! Serve as one of the members in two committe groups in a professional society, respectively. That is all!

I am thinking even with the lawyer's help, my creditials is not enough to persuade the NSC that my accomplishement is very significant above the others in my field. My paper need at least 2 years data to get published and I am almost in my 4th-year H-1B. Not sure if I should wait for more citation after the paper is pressed or I should continue or give up?

How your guys prove yourself to the Immigration Officer? What kind of evidence do your guys use to make your I-140 approved based on NIW, esp in NSC? Any suggestions are highly appreciated!
 
NIW depends on three things
proving national interest
intrinsic merit
&
proving extraordinary abilities.
all three are important and related to each other.
You have to prove that your abilities are essential for project and u r 1-2 % of peopl ewho can work on that project successfully. I guess in your case letters will play very important role. Citaitions are essentail not not 100% important. When I filed my case I had 20 papers and all recent and i had barely 30 citations that time which was bad for 20 papers. but my officer didn't care much for it!!! SO sir!!! don't get discouraged.......DO little research of RL and you will land up writing good NIW case!!!!!!!

Thank you for your encouragement. Yes, as you say, there are 3 progs for NIW. The first two were not a problems for most of the NIW cases that were denied by the immigration officer. The only problem is the third prog: to prove my extraordinary abilites.

I asked several professors to write me such letter. But most of them asked me to write a draft for them. I have started writing the draft, but find difficult to write such letter without too many evidence. I mean I cannot say I am 1-2% top among others.

Could you give any suggestions how I could get some tips to write a good RLs?

For NIW, you dont have to prove "extraordinary abilities". That is for EB-1A petition. FOr EB-2, you have to be "exceptional" and you need to show that your accomplishments are "substantially" above what is normally encountered with a person with similar qualifications and experience.

good luck with your application. You never know, so dont be discouraged. NIW is time consuming, but at least it worths it. ..

can you tell me where you find the sample cases from NSC, and other sites?

Well It depends how you see it! When we propose that your work is of national interst and you carry best possible skills to do that.....then would call it E Skills.

True. But CIS is also clear about the difference between EB1-EA and EB2-NIW. It is, of course, quite another matter that the difference is shrinking these days!
