To all ye Gurus out there, please give some input.
I am on a H1,working in private practice, filed before retro and got my EAD.
My question is, when I am eligible to change jobs, can I join a fellowship program using my EAD or will that violate the AC 21 ?
Please advise.
Thanks a lot.

For AC21 the job has to be similar is my understanding. Fellowship and private practice can lead to problems. DO you have a lawyer.

Can I use the same industry(Health) and same profession(Physician) to justify doing Fellowship on an EAD(obtained while doing pvt practice?)

What if he keeps moonlighting as IM and continue his fellowship? It is tough in most 1st year fellowships but not impossible to do hourwise.

NIW has to be for full time job (40 hours).
Fellowship is also a full time work. so you can't do both.

no you cannot ....they are very particular about that
use EAD to work only in the same situation as before
When will they know that I used the EAD to do fellowship, after all I have filed the I 485 already and I am just waiting for my GC?
Please enlighten me!

May not be advisable

exploitedMD,

One can also get called for an interview as part of AOS. If that happens and they find out that the job description has changed then can pose problems.
Discussing this with a good lawyer is best. Moonlighting during your fellowship may be an option.
