a) F1 student graduated in May 2003

b) Got Married to Permanent Resident in April 2004

c) Completed OPT in May 2004

d) Filed I-130 in May 2004 before OPT expired.

Advise please:

1. What is my status?
2. Can i join a home based business? or can i start one?
3. What additional INS forms do i need to file? if any?
4. Do I have to go back to my country and wait for immigrant number?

None, if you didn't enter a new program on F-1 status.

illegally - yes

none, until your I-130 is approved and you get a visa number

4. Do I have to go back to my country and wait for immigrant number?
it would be advisable, since you didn't accumulate any illegal presense yet. Try to get reinstated in F-1 status if you can first. or you can sit quietly and wait until your spouse becomes a citizen and then adjust your status without leaving the States.

I have a 3 months old baby born in the Us,

In the event that i start a home business and INS finds out, what happens to the baby?

Do i go back home with him? or does the state take him away from me?
 
INS doesn't care what happens to the baby. If the father of the baby allows you to take him out of the country - you can do that.
