Just recieved my i 130 and theres a big problem they have my name all messed up from the first to last name ex my real name is Richard Antonio Dalhousie and they have Ricardo anthony dalhouse how would i get that change the problen is that i had a birthcertificate that had that name originally and i had to have them change it and had recieved the right one with the right spelling, in my country they had a big hurricane and alot of the important things got messed up for those whos goin to ask so do i have to give them my birthcertificate to prove that its my real name. I was thinking it was my lawyer seeing that she filled out our papers for us and a half my wife too because she has all the important stuff so how do we get around this knowing how these people are always thinking someone is always up to something....

Siebu,

This is what I would suggest that you do, not sure if the I-130 has been approved or it was just a receipt of your filing. Irrespective of what is for, you should write to USCIS office in Montana, which is where your I-130 was processed and indicate to them that your name was entered incorrectly in their system. All that you have to write is this in the letter:

To Whom it might Concern:

Please find attached copy of recently filed I-130 petition for Mr. Richard Antonio Dalhousie. The name entered into your system and appearing in the attached notice is incorrect, and hereby request that this error be fixed immediately. The incorrect name is: Ms. Ricardo Anthony Dalhouse, AND THE CORRECT NAME which should appear in the I-130 notice is: Mr. Richard Antonio Dalhousie.

Look forward to a speedy resolution to this matter.

Mr. Richard Antonio Dalhousie.

That's it...

And do i have to send a copy of the birthcertificate..

Yes. Any time you contact them to correct something about your name, you have to provide proof of your actual name.

Are you saying that the birth certificate provided for the I-130 had your wrong name? Or was it just your I-130 paperwork that had the wrong name? If you gave them a birth certificate with an incorrect name, it might take more than a letter and a copy of the birth cert. to set things right. You might have to sort it out in the interview, bringing both the wrong and right birth certificates, and other documents to corroborate the correct name (e.g. your passport).
