Different kind of RFE for EAD

My EAD WAC#030455xxxx. Last I entered USA in Dec'02 with
AP. SO I was not subject to special registration (I'm from one of those countries who needed special registration) and I didn't do that. In my EAD RFE they are saying that their record says I was supposed to register and they don't see it. So I have to send them documents which will prove that I was not suject to register.

So guys, do you know what can be those documents that will prove it? Is there any one else who had the same kind of RFE?

and "I was not subject to special registration"

Why are you not subject to special registration?
 
strange.

RFE is not for intimation, but request fo rsomething. So they will tell you what they need. According to you, this RFE is just a statement. Can you elaborate on the RFE?
 
I think special registration was required for the citizens of some countries if they entered US before some date(i guess that was in dec). Anyone who entered US after that date need not appear for special registration(i remember reading it on some site).

RFE is saying ".........Submit a photocopy of the front and back of I-94 card that indicates the registration......If you believe you are
not subject to this requirement, you must submit an explanation
of such with supporting evidence."

My question is what are these supporting evidence?

I think you have to submit a photocopy of the front and back of I-94 card, a photocopy of the advance parole. I don't know about "Anyone who last entered US with AP didn't have to register", but you have to write letter explaining this

I think you should send them a copy of your stamped AP with a explanation that you were paroled into this country not admitted, so according to BCIS instructions you were not required to register. Did the BCIS officer at the POE told you that you don't need to register then you should mention that also.


Now my question for you.
I am planing on going home in next few weeks.
Did you had any problems at Dhaka airport? Did they recognize AP right away.

What airlines did you fly?

Can you please share your experinces? I heard sometimes they don't understand AP and creates unneccessary problems.

I got the same RFE

In my case however, I am not even a national /citizen of those countries that need special registration. I was born there however but always carrying an Indian Passport. My lawyer sent an Affadavit stating the same, about me not being a citizen and hence not requiring registration.

Waiting to hear from BCIS.

i wouldn't be surprised if it takes the officials at zia an hour or two to figure out what is an AP and start calling the emabassy to decipher the text. Given the scrutinization invloved in a simple H1 document, I doubt it'll be easy.

Having said that, since AP is a legal document accepetd as proof of entry at any port, you will eventually be allowed to board, but only after some very amusing question and answer session.

gc_hopefully, I didn't have any problem at Dhaka. They looked at the AP and understood right a way. Rather I had a little problem
at Bangkok. When I went for boarding pass, they ask for valid VISA or so and I showed them AP. They didn't understand and called some one else(may be some other department). I had to wait about 10min and then a lady came in ,checked the AP and cleared me up. Other than that no problem, no issue, no hastle.

Person's possessing AP doesn't need to register

I am also from a country that needs Special registration. I recently applied for my H1 extension and I got the same RFE. Proof of special registration required. Infact I proactively sent my I94 zoom picture & special registration FIN# to my lawyer but thanks to my sluggish attorney he didn't bother to send that to INS while applying H1 and I got the RFE.

Anyway , later my Attorney sent I94 copy and H1b was approved within a week.

Person's entering on AP are not subjected to Special Registration.

You should send your I94 and AP copy , with INS memo that states that Parolee are no more required for special registration. In san jose if you even want you can't do special registration with AP , they will turn you back from INS office
