Different dates on Green Card (Resident Since) & I-485?

Hi,

I have different dates on GC and I797-C. I 797C for I-485 is about 10 days later? Which one should i use for calculation of 90 days prior for Employment based application?
 
Call up and ask USCIS what date they show on their system. The last thing you want is to get denied for a date discrepancy of a few days.

I would use, the date on your GC since you have to send them a copy of the GC any way.

Dates on GC have been proven to be wrong in the past. There was a poster several months ago who was denied based on date discrepancy on GC and what the USCIS system showed.

I suggest using the date that is the safest. If the GC shows 100 days to eligibility date and the other one shows 90 then uses the GC and add a few more days to that too so you will be filing well within the 90-day allowance, say around 85 days.

Personally I would wait until the worst case 5-years is up before filing. Given the speed of processing it is possible your interview may even be before eligibility date and they will postpone approval until after that date. That can introduce delays for the Oath letter and ceremony.

There are several recent stories here on this topic. Do some searching and reading.

My card and passport stamp (I-551?) both show a date of 10/xx/2004. However, the "Notice date" on I-485 Approval notice is stated 11/yy/2004. Does this imply a discrepancy - that requires enquiry?

If the I-485 NOA date was the same or before the date on GC I'd say it's a non issue, however since your I-485 NOA date is after the date on GC, there's a small chance for discrepancy in dates according what USCIS shows. It takes no time to call USCIS and double check what their system shows. Whether you want to take the time to do so is up to you.

I called, but was informed that they did not have "access to personal records". (I do not know know if I should have asked to speak to a supervisor). Nonetheless, I described the situation to the gentleman - that the dates on my PR card, and I-485 Approval notice were different. I asked, which would apply, and he asked to go with the former.

What are your thoughts?

You should be fine. The first level agent won't be able to confirm the dates on system..you'll need to talk to an IO instead by "telling" the agent it's been more than 30 days since you applied and haven't received receipt yet. The agent will transfer you case to an IO who will be able to confirm the date on their system.

An after-thought:

When USCIS stamped my passport in Phoenix (DO?), I assume they referred to their "system"? Again, when USCIS printed my PR card (at the ASC in CA?), I assume they again referred to their "system"?
Would it not be safe to take confidence that two references to their system resulted in the same date?

Yes, that would be a safe assumption in your case.

I had the same question couple of months ago .... you can search for those threads ...

The date on my GC is more than 6 months before the date on 485 approval notice .... at that time I simply thought the approval notice was triggered by my PP stamping at the DO so I ignored it.

I went with the date on my GC and applied n400 and everything went well.

There is another user from Detroit (I think his nick is 'elsohage' or something) whose date differed by 10 days (GC date was before and it was a mistake by uscis but the OP applied n400 based on GC date) and his n400 got denied because of it. BUT he fought back by firing letters to DO director, obmudsman etc ... and uscis re-opened his case and approved it after couple of months ... you can search the forum and find the threads as they are very recent.
 
My greencard has a PR date 6 months earlier than the actual approval date. The PR date they put on my greencard is the date they received by AOS application. I went down to the local DO and they showed me a printout of my record also showing a the earlier PR date. So I guess the only place they have the correct date is in the original file. I decided to apply for USC based on the actual approval date because I didn't want any issues. I thought the IO might notice that my PR date is only a month after the marriage date upon which AOS app was filed.

Although all might not be clear sailing based on filing on the later date. It seems that the system generated a bunch of I-485 approval notices sometime after my case was really approved and I received the card. I'm keeping a tight hold on the first one they sent me to show the actual approval date.

If only there was consistency.
 
Many approval notices have the date when the notice was printed, which is anywhere from a few days to a few months after the GC approval.

My approval notice is dated 3 days after the Resident Since date on the GC. However, I know the GC date is the right one, because it has the same date that I got the Card Production email. But because it is only 3 days difference, I'll wait at least the 3 extra days to avoid the potential hassle.
 
I am planning to send in my n-400 by july 14 based on the date on gc. can some of you please read some of the info below and advise if i have got my dates right. Thanks.
