Different A#s in I-140 and I-485

Hi,

My I-140 approved in EB3 and pending I-485. My priority date is Jan 2005. I noticed that my A#s in I-140 is different from that in I-485. Is this an issue? If so, how can this be resolved?

---Do you have your I-140 approval notice with you? Do you see A# on I-140? Did you had A# in Past? Did the lawyer who filed I-485 wrote the A# that is on I-140 approval notice? I-485 is your Latest form you filed with USCIS use the A# that is on I-485 reciept notice in future for forms like EAD, AP or H1 EXT filing.

Did you apply for the I-485 after the I-140? If yes, and you left the A# blank on the I-485, that is probably why you got different numbers. You were suppose to take the A# from the I-140 approval and write it on the I-485 application.

From now on, keep using the A# on the I-485. You really can't do anything to resolve it. But it probably won't cause a problem for your green card. It's when you apply for citizenship that it may cause some delays when they have to locate and merge both A-files.

I switched jobs and employers and my new employer applied for a PERM and I-140 in EB2. Both approved recently. My lawyer requested to recapture my previous priority date in my most recent EB2 I-140. She quoted my A# in the EB3 I-140. USCIS did not give the previous priority date, instead they gave the date of my PERM filing, as my priority date for the EB2. Is there any way this could be fixed and I can recapture my previous priority date?

I will very much appreciate your response.

To port the priority date to a new I-140, the old I-140 must be already approved. If the old I-140 was not yet approved when the new one was filed, that would explain why they didn't port the priority date. Otherwise, it is a USCIS mistake for not recognizing your lawyer's request. Either way, you or your lawyer needs to ask them again to port the old priority date to the new EB2 application.

Ask your lawyer so that he/she should write to USCIS to port the early PD. provide the copy of old I-140 approval notice and copy of I-485 filing reciept to lawyer.

However, can USCIS say, that it lawyer's/Petitioner's error to reference the A# in I140 instead of referencing the one in I485? And, as my I140 was applied in Premium Processing(PP), will any further corrections will also go to PP Unit?

------They can say it is Lawyer error or your mistake not to write your A# on I-485 if you had A# in past But they will fix the problem of dual A#

Lawyer should write to service center where I-485 is pending and should make a request to recapture early PD and should provide Copy of Past I-140 approval notice+copy of I-485 reciept. at this time Premium Processing Unit has nothing to do and the officer who will look at I-485 should have papers/request letter with Evidence from your lawyer so that they attach to your I-485 file. It seems you dont have good lawyer.

-----------When the officer pick up your I-485 file he is going to look for your Name, DOB, father Name, Mother name, social security number in USCIS computer system and they have also your G325 form and he can find that you had A# in past and they fix the problem and go by your latest A# that is on I-485 receipt notice. No need to worry.

------------ You can write a letter with copy of I-485 filing receipt and out side the envelope write in big bold letters: ATTN: Dual A# assigned please correct it. Explain the matter on cover letter with your Name, DOB, Address, Your A# on I-485 filing receipt and Copy of I-140 that has different A# on it and sign the letter with date. Send the letter to service center where I-485 is pending. Keep the copy of each document that you send to USCIS.

You are Mixing A# fix and to recapture PD
1. They will fix the A# and will go by A# on I-485 receipt.
2. To recapture PD Lawyer was supposed send the Copy of EB3 I-140 approval notice with I-485and he was supposed to write in cover letter that Please recapture the PD of past I-140 approval in EB3. Ask your lawyer what he/she did or let him write letter to recapture the old PD. Lawyer and USCIS will need evidence of Past PD to recapture that.
