Thanks for all your suggestions in the earlier thread regarding the same. The latest updates on these are:-

To send a covering letter saying that original salary as mentioned in LC would be given upon approval

Or To generate 3 pay stubs that would match the LC's salary.

I understand that as per the immigration law, its expected to maintain the LC salary thru out the GC process. So, do you think that generating a revised pay stub, (though the company agrees for the same) will solve the whole mess. Will this have any effect on W2. Since, there is enough time for the RFE to be responded, your suggestions and experiences on this will be of the greatest help.
 
SM,Vipsha,PCee experts..Please answer my concern. Thanx in advance. My biggest worry is whether the whole wait for i-485 is going for a toss just becos of the reduction in salary?!

Salary on labor is promised salary which does NOT mean that it needs to be paid while you are undergoing the GC process. Offcourse you will need to make it after you get your approval.

At the time of RFE, it is sufficient that your company provides a letter saying it will pay you the salary stated on the labor, upon approval. If your company has strong financial standing, there is no reason why the above should not fly. People have done it before.

On the other hand, reduction in salary seems to be the norm in these depressed times, and there might be slight leeway if your case IF, you make slightly less than the LC salary, but more than the standard average wages, for your job description, in your location.

In case you decide to go with the first option, I would advise you to MAKE sure your company DOES pay the LC salary upon approval. Don't think it is just a formality to hand a letter to INS saying you will make it upon approval. In times of heightened security, they are bound to check and it might be cause for withdrawal of approval!
