Curious to know if people who are in the US on H1B have also applied for Canadian immigration, simultaneously.

1. Did you get the GC ? or which stage ?

2. Keeping the Canadian immigration active (by staying in canada on and off) ?

3. Did Canadian immigration cause any problems for GC ?

1. Did you get the GC ? or which stage ? EAD and AP has been cleared. I485 is pending.

2. Keeping the Canadian immigration active (by staying in Canada on and off) ?
Well, my Canadian PR is active (so far). I became a Canadian PR on May 2005 and I have visited my parents (in Canada) on and off in these past few years. I do plan to go in Dec but not sure, how to tackle questions relating to my status in US/Canada. I haven't gone back since 2006. There is a rule that you should have physical presence in Canada 2 out of 5 years. In 2005 they had asked me "What was I doing US?" "Why have I not yet moved to Canada"

3. Did Canadian immigration cause any problems for GC ? Not that I know of

I hope it answers your questions?

It is not a problem, but they could bring this up in interview if at all they schedule for one.

They might ask you,

1. Why did you apply here and canada? Keep a convincing answer for that.
2. Do you want to keep the canada GC or US GC,
a. You cannot say both, you have to abandon either one in that case.
b. If you say you wanna keep US GC, then they will contact Canada
immigration to cancel your canadian GC.
c. If you say you wanna keep canadian GC, then they will cancel US GC right
away.

Both are independent and you have certain obligations to preserve the validity for each of them. Of course, it is impossible to maintain both.

US or Canada

It seems the first option is, for the first 5 years I could just wait and hope to see some change for betterment in the present situation (retrogression) In the mean while go to Canada and get PR and try to visit for atleast couple of moths every year.

Or second option is go to Canada get the PR and in the first 2 years wait for things to change and then in the third (decision year) year go to Canada (forget GC) or give it up.

Right?

GC is for permanent residency so you can't say you want to reside permanently in both US and Canada, but I've seen plenty of cases where an applicant gets both. You qualify for GC as long as you have the intention to live in the US, and most people do have that intention so it shouldn't be a real problem.

Commuter Green Card

Both are independent and you have certain obligations to preserve the validity for each of them. Of course, it is impossible to maintain both.

There is an exception.

If you got Canadian PR card and US green card, the same time you physically live in Canada and work physically in US you can save both.

For example as I know you can change your American GC for commuter green card and it will be not cancelled. But you need to have job in US to do it !!!! As I know it does not work in the opposite way, Canada does not have commuter PR card.

The only problem is that time on the commuter green card is not counted towards citizenship.

And of course you need to live very close to the border from the Canadian side and very close to the border to work on the american side.

There are two places in US where you can practically work and save Canadian PR card.

1. Detroit and suburbs, 2. Buffalo and suburbs.

Two of my co-workers have US commuters green card (work in Detroit) and live permanetly in Windsor (Canada). They commute each day to work.
