Did anyone see Immigration Watch lately

During my recent visit to Immigrationwatch website I saw impressive number of approvals on I485s. There are atleast 14 pages of 485 approvals from '04.. Seems like TSC will jump to '05 immediately once they clear the remaining cases of '03. Makes me wonder how could they skip me and rest of the concurrent 04's. I am waiting since Jan/04.... Where's my gc??

I think TSC is not being fair at all. This is just a joke, it's a lottery!

MVUSA, not wanting to denigrade your case, but hopeful1 has a priority date earlier than yours. It is just bad luck that some people's labor took more time. My interpretation about hopeful1's case is that if he is from a visa number retrogressed country, his concurrent would have been converted to separate filing because his/her PD would have been retrogressed for a few months around the time of his I-140 approval.

That said most people on TSC forum deserve better as compared to CSC where the I-485 date is 05!! Hopefully retrogression accross all categories and countries will bring back some equity for those like you and others with PD from 01/02 who are still languishing for approvals.

Thanks for your information. What I don't understand is the roll my PD plays in this process if I'm from a non retrogresses country. MY PD has been current since I Applied...so i really don't get it.

I personally don't think PD plays any part in USCIS's processing. PD is DOL's problem. PD plays an important part when dates are retrogressed. USCIS is evaluated based on 485RD for each application. USCIS is clearing 04/05 to prevent from new backlog taking place while still clearing the backlogs of 02/03. Anyone who has been retrogressed at any stage may not be a priority for USCIS because they will remove them from their reporting backlogs because the delays can be attributed to visa number availability.

Please see my signature and comment on my Processing of 485. A Friend who filed in Aug'03, got 485 approved 1 month back. I think, luck plays significant role. Good Luck !!!...

Although a lot of what you say makes sense, nothing is for certain. At TSC about 60-70% of the cases are being processed in the way that you mentioned. However, there is no accountability for the remaining 30-40% of the cases. These cases (mine included) have been delayed unneccesarily. My PD is August 01 and my RD is 03/04 and I am still waiting on my 485 approval. An RFE was issued on my wifes 485 (dependent) and it has now been over 60 days since the reply was acknowledged. Forget about my case, there are people from 01, 02 and 03 still waiting around for an approval.

Clarical errors, name check delays, incompetent officers, lost paperwork ... these might be some reasons dealying our cases. There really is no way to tell.

All one can do is hope that their case falls under the 60-70% of cases that are processed effeciently. If by the luck of the draw one ends up in the other half, its going to be months if not years of misery.

Bangla Babu, luck does play a part no doubt because different officers have different speeds and other application/petition loads as well. In general a complete application goes through faster. In your case did you have a change of address that triggered an EVL? or did you have a change of job as well? I changed my job but promptly filed a detailed AC21 petition with pay stubs etc to avoid getting an RFE later when my file will be processed.
 
What Say Bout my case?

My PD is Nov 2002 and my case was Transfered to Charlotte. I was interviewed at Charlotte in March 2005, and was given a Verbal Approval, but did not stamp my PP due to EB3 retrogression.

SO CLOSE.... BUT YET TOO FAR :(
 
Waiting is the name of the game. I have reached the point where I want to hold my breath and not care about the outcome.

I-485--Interview?

Everyone,
After reading your concerns and postings on this discussion, I decided to ask you about an issue that I am not clear on: I-485 applicants who are employment-based are asked to go for interview? I know that marriage-based adjustments go for interviews. Have any of you received an interview notice after FP or other time?

If your 485 is approved by TSC then there is no interview involved. You just have to setup a infopass appointment to get your PP stamped. If however TSC transfers your case to a local office, then the local office will schedule an interview. The local office usually approves the case right after the interview. I would not worry to much about an interview.

I have seen so many cases who are waiting for approval after AOS interview.
You can count me in that list.

Reasons for not approving at AOS interview:

1.Name check is not complete(Mostly primary or dependent)
2.140 not approved (This type of cases are rare and unfortunately I am in that list)
3.A# is different.
4.AC21 cases
etc

I agree with you. Anything can go wrong at any time. However, not all cases go through hell like yours and mine have.

In my case everything is clear... Name Check etc, etc. I'm not waiting on anything. BUT JUST A VISA NUMBER.

The officer infact went inside to get the numbers but returned saying that there is no Visa number available, so won't be able to stamp your passport.
OFFICER SAID:
"THE GOOD NEWS IS THAT I"M APPROVING YOUR CASE TODAY"
"WELL THE BAD NEWS IS, I DO NOT HAVE A VISA NUMBER TO STAMP YOUR PASSPORT."

What say folks isn't this BAD LUCK????
 
Hi guys
Does any one you have the stats of EB approvals for 2002,2003,2004,2005 so far and how many of it is pending less than 2002 Jun? I am trying to figure out the PD movement.
