Did any one get this Type of RFE

Hello,

I received a RFE for Medical Waiver(Myself and spouse) and not sure how to proceed.

The Physician's who actualy did the medicals had checked that "Automatic Waiver/not available" for the TD Vaccination on Supplemental form I-693, so they have sent back the original I-693 form which the physician sent to them and asked to verify why the physician has indicated like that, as the the waiver was between the period Febreuary 1st 2001 to September 30 2002 and my Medical documents was showing the date of December 10th 2002. But when I checked with my lawyer, they say that I can take new medicals again and reply to the RFE with the new Medicals.

If any one has gone through the same situation please share some light on this.

It's up to you if you want to redo the whole medical.

If I were you I would only respond to the PART/PORTION THAT USCIS IS TALKING ABOUT, which in this case your TD vaccination.

Obviously, your doctor made a mistake on giving the waiver, why not get back to him and complete the TD vaccination plus a written explanation.
Some of my friends and the Rupnet and ImmigrationPortal users got similar RFE too and they only had to complete the missing part. And they all got approved.

Same situation here..

My wife cannot take the MMR and the tetanus vaccination now, since she is pregnant, my lawyer says, I can get the whole medical done, or just reply to the part of RFE in question.

USCIS says on the RFE, they are returning the original I-693 form, but my lawyer says, he did not recieve, in this case how do I reply ? Can, I ask the hospital to fill out a new form with the previous examination, will they do it, or am I better off, getting a new medical. Moreover, the doctor who first examined my wife is no longer at that hospital, what option do I have here ?

Thank you for the prompt reply to my post sinting, Is it ok for me to go any other doctor or should I have to go to the same doctor for completing my TD.

My suggestion is get the TD vaccination from the same doctor, since it is lot easier. All he has to do is open the sealed letter and add the TD vaccination info, seal it back and give it to you. I had the similar situation for varicella vaccination.

You need to put more investment in your green card if I were you I wouldn't take a chance, time is money.
It would be okay legally to respond to TD immunisation only, BUT how about if they send you another Rfe for expired medical. 200 dollars is not going to make you bankrupt man. You never know if they receive your new medical they may just approve your case and you will be the happiest guy forgeting even the 200. DON'T TAKE CHANCES
 
Sure Ziri, you are right, I am of the same opinion, my concern was, what if USCIS questions, why did you do the medical again, do we have to go through all the medical exam again ?

I have scheduled for a complete medical examination for my wife, that's the best thing to do, I guess, thanks for replying.

RFE on expired medical ???

So far I haven't heard anything like that.

If they think your medical has already expired to begin with, why don't they SPECIFICALLY request you to redo the whole medical in the RFE letter in the first place ?

Again, every single applicant that I know got the similar RFE just completed the missing part (or the one USCIS is referring to in the RFE letter) and they all got approved.

But the choice is all yours ;) ;)
 
I just checked with a Doctor(different from the one where I got my previous medicals) and she said as there was a shortage of vaccinations for TD at that time(2001 - 2002) so they had issued this waiver and said that she will just do the TD shot and submit the TD supliment for further processing.

Also I checked with my lawyer and he said to adhere to the the RFE only as they had reviewed my application and sent only this one. If they found any thing more they would have definitely sent them at that time. So I am going to do only the TD shot and with a different doctor this time as I am currently staying at a different location.

Will it be alright if the doctor fills in a new I-693 with the previous information and update the vaccination information on that form? Do you guys think that USCIS will say they need the original, which they say they sent, but did not. Looking into all of this, I made an appointment to go ahead with the new medicals all over.

For me, they sent the Original I-693 supplement (since i had an issue with that form) in a sealed envelope to be opened by the doctor. The necessary details were re-filled by the doctor and re-sealed in the same envelope.
 
Hello,

How long will we have to reply to the RFE ? The RFE we recieved is dated Dec 16th 2004, it does not say by what date we need to reply. I am replying to it today, but, just wanted to know, what is a typical timeframe.
