Hi,

I have a question about a J1 waiver. My wife might get residency in Detroit. She is a Canadian landed immigrant so she lives across the border in Windsor, CA. She will just drive across each day to work on J1 visa. Does she have any exception to J1 waiver because she is already living outside of US when the appropriate time comes? Does she have any benefit because of this?

I haven't read anything about it. It seems the 2 yrs should be served after you finish your visa term. By the way is she going to go through all the border carp twice a day or I am not getting it? Honestly I wouldn't mind spending 2yrs in Canada, but if it bothers you why don't you/she take step 3 and go for H1. Usually residencies are exempt from the cap and although they might say the "never" sponsor H I have seen it happen all the time. Just have a good immigration lawyer and be willing to compensate the fees. It will be cheaper in the long run.
 
how about TN visa? would it apply in her case? Otherwise, it's just ridiculous --- get J-1 visa to drive through the border every day and then still spend two years in Canada fullfilling HRR after the completion of the program.

Thank you for the responses.

I think the key is that she still has to stay out of US after completing residency to meet HRR and therefore does not get away just because she is currently living outside.
