details about my arrest

yuja11, I would not worry if i was you. All you need to do like davidm922 said just prepare evidence to show the judge and the prosecution that your marriage is bona fide. College as much evidence as you can make three copies of all your documents. a set for your self, the judge and gov. lawyer. The most important this you need are all the receipt you got from USCIS to proof you have paid and filed what ever forms you did. If your I-130 has been approved thats a huge plus for you. Immigration courts & Dep of Justice have no due restriction over that. So If all you have left is Your I-485 the judge will approve it as long as you can show evidence that you marriage is bona fide. Your case is straight forward and simple so don't stress about it

Good luck

The Word

You are assuming the worst for people who came illegally into the US are doing all those vile things. Let me tell you... legal immigrants do some of the most vicious and inhumane things to other people in this country. Not to mention what they do to people of other countries If you google the heinous acts which have been committed by legal or illegal immigrants, immigration status is of no consequence, just the deed.:cool:Evil deeds speak louder than evil words

In terms of suing ICE, you have no basis to file one of these frivilous lawsuits which clogs our juducial system.Like Brown, Escobedo and Miranda So, just drink a glass of water, eat some cheetos and have a deep breath, then your anger will subside. ICE will be happy to serve you a glass of shut up juice ICE can arrest you for failure to meet the conditions of your student visa, and they did. Did they err in arresting you, it is possible and a competent Judge can make a ruling. However, spending time consulting with lawyers about suing ICE is just hogwash and bull...;)Who needs the sixth amendment anyways?

There are many people who are arrested before their wifes, children, cats and even squirrels....:D.Contributing to the delinquency of a rodent is a felony Being being arrested in itself, is not a crime, unless they "plunged" your butt...:Don't ask, don't tell( You cannot claim abuse or emotional stress for being arrested, because you have to show injury, which a reasonable court to assess fees. Heed this advise: Focus on legalizing your status.. rather than on trivial and inconsequential crap... :rolleyes:Like civil rights

Your point that illegals aren't arrested is bogus...Catch and release rule in effect If you go before a judge and claim that illegals aren't arrested, but your as a "pending" legal immigrant was arrested, the judge will bust your nuts up.Don't ask, don't tell This is like being stopped for speeing by a state trooper, and you turn and tell the trooper, "well... there was another car going at 100 mph, and I didn't see you stop and give them a citation".Worked for Lindsey Lohan All people are created equal... but some are more equal than the other...Don't ask, don't tell and you got the rough treatment... :confused:Almost as much fun as a high colonic

Aside from my best imitation of Stephen Colbert. Here’s what you should do:
1. Keep calm. We’re here to help you.
2. Write down everything you remember. Be honest and thorough. Don’t color the facts. If officer was mean just write down what he or she said and did.
3. Contact your local chapter of the American Civil Liberties Union or a local law school student clinic or other law clinic for advice.
4. Be vigilant, the price of democracy is eternal vigilance.

5. Appear in front of the judge and be honest and humble. Bring along a lawyer. If you forgot to submit a form, blame yourself. Mea culpa is good, you-a culpa not so much.
6. Realize that soon you will become a citizen and you won't have to take this much longer Bush's term is almost up.
