desperately need help. cased beyond JIT time, 3 fax inquiries are done, nothing happened

my spouse\'s case RD Mar. 01, did FP on Feb. 1, my case was approved in mid Mar. (I am the primary applicant, my spouse was dependent, we did FP the same time). Now it is beyond JIT time, I did 3 fax inquiries, according to the fax inquiry form. I called the center\'s director\'s office at 949-389-3007 but was told it is for lawyer\'s use only. we don\'t have a lawyer, we filed by ourself. Is there anything we can do? so desperate, my spouse is on his H1, never out of status. Any suggestion is appreciated.

It happened to me as well as to my friend (at various stages, after waiting and sending faxes, felt that did get any response...). The important thing is keep sending faxes, send a letter too through registered mail, try calling IIOs too. some thing will click. Make sure that you are sending fax to right number. In all those fax enquiry sheets (flying on the net) it is specified as Div IV handles AOS cases but it seems now Div I handles those cases! So make sure you are sending fax to Div I.

I did this while waiting for my receipts, my friend did this while wiating for his FP notice. In my case I got receipts after 10 days, in my friend\'s case he got an e-mail from an officer as a response to some fax/mail/IIOtalk enquiry (don\'t know which one clicked) and things got fixed.

Make sure you follow the intervals specified in the fax procedure. I think it is 10 days or something.

I would suggest talking to an attorney - Morpheous

I would say wait for some time, when CSC start approving cases then try an attorney

and also, we filed I-485 by ourself, and you think getting a attorney now will help in any way, because I understand attorney has to be involved from the very beginning of the filing.

I guess atttorney may not want to get involved just for followup,

where is there is not much money to be made.

Hi Hellen

It seems that CSC is holding back on 485 cases pending a new security check. I would say a wait for them to start approving cases, in case they still do not respond to you then hiring a lawyer is more safe, say, ur case is transferred to local office. Although I sincerely hope you get the approval before all this.

hi, sonofindia, I sent three faxes on 4/2, 4/11, and 4/18, to the no. on the fax inquiry form.

PCee said they changed the no. or changed the division, and where can I find the most updated correct no.?

I do not know the new number or division. However, as Pcee mentioned, you can try changing the DIV to DIV I and then faxing the inquiries.

I would also suggest talking to an IIO. I had read a post where an IIO went out of the way to help in a case similar to yours and that guy got approved in a couple of weeks. Worth tryting, isn\'t it.

Its just one month and you already sent 3 faxes... This is why INS does not bother to reply any fax. My I-140 took 4 more months than my colleage although both were filed at the same time. Never made any enquiry or called INS. Different files go to different officers and they work on it at different time.

Whats the big deal, its I-485, does not make much difference if it is approved after 3 more months, does it? Specially when you are principal applicant and your I-485 is already approved, there is no reason to think that your spouse\'s I-485 will have any issue. Still, you are jumping like a monkey. Just wait and everything will be OK.

People like you clogs INS tel. leaving legitimate people keep trying to get the number.

Those fax numbers specified on that Fax enquiry sheet are fine, except that now "Div-I" is handling I-485 cases (so send enquiries to fax numbers specified for Div-I). I would follow time gap specified in that sheet though! Follow below link for that fax sheet:

Please send 6 fax and call 5 times a day

by all your means. INS will do the things when they wish to do. Clogging the lines does not avail anything. The right thing should be that you should wait for sometime after sending the fax.

I have seen people calling FBI several times for finger print verification, INS to see if the system has been updated and so on.... but there is no indication that their cases are expedited.

By the way when I said "I did not enquire about my I-140" I meant "I could not" because every time I (or my HR) called the number was busy and I have other important things in my life to do rather than just keep trying that stupid number. It is immposible to get that number because of stupid like....

If your I-485 has been approved, there is no ground for denial for your spouse. Even if there is, you can\'t stop that by keep them calling. What difference it makes if my spouse does not get her GC in next 3-4 months. She already has EAD so if she wants she can work..

Some times INS can loose someone\'s file entirely or misplaced some where and unless start enquiring no one is going to bother about it! Don\'t you think it is resonable to find out that every thing is in place but all one need to do is just wait? By the way also note that people filed in March 2001 actually got their approval around Sept, Oct 2001. Some how their case is delayed (starting from FPs)...

i dont think so ...

the reason being all your records are in a database and thats probably how they track them when they process cases. I dont think cases are physically assigned to officer but are electronically and that in turn drives the physical files to the correct desk. SO if a physical file is missing it would generate an RFE when the officer notices it.I have seen some cases like these where they requested everything again.

You are assuming that INS works on files eloctronically but as far as I know it is not true! INS works with paper files! INS is struggling to change it from decades.

You are thinking that how cases should be allocated is decided electronically but in reality (based on all the comments/experiences on this board and conversations with IIOs) once the case is adjucation ready the case is returned to a monthly shelf and officers pick up cases from that shelf for adjucation (phisically). Now let\'s say that the phisical file is missing then there is no way one can find out about that case until some one starts enquiring and some one starts looking for that particular case! One of my friend went through this, CSC lost his I-140 file completely and after wating for a very long time they started enquiry and as a result to that enquiry later CSC responded saying that they are not able to locate the case and asked my friend to file it again. Then my friend with the help of local senetor brought some pressure and some how they found the case and approved it with in coule of days!

Missing some papers is one thing (where officer can ask for those missing papres through RFE), and missing the entire file is another thing! It is some thing like one is not there is the processing Q!

I heard the same thing

My lawyer said there was a case where an I-485 approval case was taking much longer than usual. They went to court and only then they came to know that the physical file was lost. The approval came 15 days later with resubmission of all documents.
 
hmmm

looks like I made a bad assumption :) If what you are saying is true then I think it is kinda easy to misplace a persons file. thank god it didn\'t happen to me.
