Please, anyone who can help me with any information what to do, feel desperate, but in back of my mind feel I can do sometning here.Came to US in 1998 as student F-1 than I applied for employment authorization and I got it to July 2002 and I wanted to extend it but never received any answer from INS.....so, lost my status. Since 1998, every year I applied for DV and this year I got lucky. I received the package in April from KCC, that I selected for DV-2007, I'm happy and scared at the same time.I live with my son(12) who is American citizen already. Please let me know if I have any any chances to do something here(petetion, adjustment.....) any information which can help me in this situation, I would appreciate.

If I would be you, I would call customer service from USCIS ( ins ) and I would ask them how to proceed. Ask to speek with an immigration officer and tell them about your case and they will tell you exactly what you have to do.

And I would consult a lawyer too.
This is my oppinion. It is you who has to decide what to do.

What is your status now ?
If you were not in status more than 180 days, you are not eligible for AOS at this moment.

hey, if ur in status, than you only have to apply for AOS, and on an F1, u'll certainly get it , you dont have to worry about that! ur case is not that bad anyway !

Congratulations !

hello ozaranok,

I am out of status after my OPT expired in March 2005. I could not enroll in univeristy again because of no financial support or stable job.

according to lawyer i consulted, he told me that I can apply within USA because i have valid I 94 card that says D/S but it is risky to go to local office and hand the application in. they might cease the application or pursue removal of proceding. they might ask you for valid I-20 or OPT card.

consult a lawyer and present your application within USA. I belive that they will not try to remove you as you are supporting your son.

I am going for CP and find job in my field. if it works out I will come back and join US Marines. I will stand up for USA with honor and fidelity because they gave me opportunity.

This will encourage KCC to keep this program running as some senetors are trying to stop this program.

Semper Fi.
