Desparately need help!

Hello all fellow GC to-be:

I need desparate help! My employer is going down and I have a big family to support. My H1B is going to reach the end of sixth year in May, 2007. Right now, my PERM has gone thru and I140 is pending. I am EB3 unfortunately.

If this really happens and you can assume that I am not planning to go back to my country, what do you advise based on the following options and risk factor:

1. If my employer cuts my pay and let me stay. If there is no other option, I will have to take this chance. But it is not desirable.

2. Change job. Assuming that I can find something quickly. Does the new employer need to file GC from scratch, meaning PERM, 140, etc? Can I keep the PERM and just apply for the new I140? If by the time my H1B has passed the sixth year expiry date, can I apply for extension based on:
a. Pending PERM;
b. Pending I140;

I am really struggling to understand how risky option #2 is since my H1B is going to expire within a year and I need to get to a point before it expires to be able to apply extension.

What is your experience and advice, gentlemen and ladies? I have a big family to support and for the sake of our children, I want to give them the best life that I can find.

Thanks

1)If you change your job now you can stay till May'07 only assuming your new Perm is pending.
2)If you stay with a curent employer till your 140 is approved(Eb3 140 processing time is quick) then you are elligible for 3 years extension.
3)when you change employer you have to start from scratch but if your already applied 140 has approved you carry your PD no matter what happened to the old one.

thanks for the reply.
OK, then if I stayed and get a new 3 year extension. Can I swtich job then? If I can, and I assume that I have to start with PERM, 140 again with the new company, and I140 will be approved again within the 3 year extension. Can I then apply for another 3 year extension based on the new I140?

This is becoming similar to code logic ;)
