Derivative asylee adjustment of status

Hi Friends,

My son has been granted derivative asylum status through I-730. Although, he is now over 21 Years of age but was covered under CSPA. He is eligible to file for adjustment of status after one year of his I-730 approval.

My question is. Will he require to get 'NUNC PRO TUNC' approved before applying for AOS or other wise? What I have researched that since he is covered under CSPA he does not need NUNC PRO TUNC approval.

Any views or comments will be much appreciated.

I did find a clear answer to my question above:-


"Children covered by the CSPA's age-out protections will no longer be required to undergo this special nunc pro tunc procedure, although it will still be needed for derivatives who marry while in derivative status before they can adjust. The new grant of asylum is backdated to the date they were originally granted derivative status"
