Deportation for Felony

Hi,
I am an F1 student, been in the US for about a year. I was arrested for internet solicitation of a minor in a sting operation. This is my first breach of law in all my life. The case is going the district court. I don't know if it will go to a federal court. And I don't know if the case would go to immigration. In case of convition, will I be deported? I know it is an aggravated felony, and that would lead to deportation. But is there any possibility for a second chance? How does the decision of my court going to affect my immigration stand? Does any of you think, there is any possibility for me to have a second chance?

The best advice for you right now is have an immigration lawyer involved during your court proceeding (in additiona to an criminal lawyer). In general, involve in sex crime, especially with a minor is a serious matter. For immigtation purpose, it is a serious CIMT, and it is a departable offense. What option will you have, will be depends on what the outcome from the the proceeding in state court. Again, get the immigration lawyer involved.
 
How long you will be in custody will depends on how fast your country will provide the paper work to accept you as a "deportee" from US. Again, depends on the out come of your situation, you may not qualify (most likely) to apply for "Voluntery departure". If you did get deported, there will be 20 years ban before you will be admissible to US again.....
 
I know as a F-1 student it is very hard to afford a good criminal attorney and then again the services of an immigration attorney. But that is what you have to do in order to have a fighting chance. With a strong legal team dealing your case, you may have a chance to plead to a lesser charge and that way save your immigration status and possible jail time. When negotiating your case, your attornies have to make sure that the immigration consequences are also taken into consideration. On the other hand if you do not do anything then you will most probably be convicted and that will mean that you will have to serve long jail time before you will be deported. If the courts will allow you, you can also just forget your dream of receiving a degree from a US university and go back to your own country. But with felony charges pending, I do not know if the court will allow you to do that or not. Good Luck.
