Dependent I485 application returned.. wrong check TSC

AOS application was filed for both of us on July 15 2007 with separate checks.

My application receipt notification and fingerprint appointment date has come.

Unfortunately my spouse’s application came back. Stating Checks not properly signed (Lawyer forget to sign one check for I485 application). Also mentioned on letter to correct the mistake and send application back Service Center.

Here are my questions…


• What fees I should pay? As per new fees schedule or old?
• Do I have to mention any think on application as dependent to me and my receipt notification number?
• Should I continue with my fingerprinting or reschedule my date?
• What are the consequences for spouse application? Do service center consider spouse application as dependent and process at the same time as mine? Or She has to wait till PD gets current

Since it is your mistake that you forget to sign the check, you may not be able to file now unless your PD is current. You can definelty try sending it.
 
Finally I have resubmitted spouse application with new fees. Lets wait and watch...Also I have attached my receipt notification tracking number as I am principle applicant.

Once quick question...What is chance of spouse to go out of status? Do I proceed with my finger printing considering spouse application in on questionable stage?

What is her current Visa status? I assume it is either H4 or H1B.
Even if her I-485 is rejected she is in legal status. AOS has nothing to do with your H status, One can manintain H status even after the AOS is filed.

That is correct. You need to be in H1 in order for her to continue on H4.
Or she can apply for her own H1.
 
No update from TSC. I got my receipt notification and FP. But then after no movement. Friend of mine filed with me same time, same center. He got everything.

Looks like I am stuck.
