Dependent Approved, Primary pending!!

I cannot believe this, I am the primary, I submitted my 485 application in 01/2003 with 7/2002 priority date employment base, and I filed for my husband on 01/2004. I received RFE on my case somewhere in 01/2005 and replied, which NSC received on 3/21/05 and they updated my online status with this information.

Surprisingly, they approved my husband’s case on 3/23/05, two days after they received my response to the RFE they issued on my case!!!. My husband already received two approval notices, one on 3/28/05 and the second one came 3/30/05. And my case status (PRIMARY) online up till today still saying “ we received your response to the RFE, it is taking 570 to 600 days to process this type of case…blah… blah… blah.””

I am worried, do you think dependent can be approved and they denied the primary? My mind had been racing with so many types of unpleasant thoughts about this. I don’t know how they can approve dependent, and Primary is still pending….

Please gurus, shed some light.

Dont Worry Just pray to God you will be all set
They would not just approve your husbands you should be receiving your
shortly.

Can you please share whatever experience you have about my type of case please. Anything you have to share will do. I appreciate all who have contributed...
 
This is one of the examples of how USCIS works :p.
First I would suggest your Husband to go for Stamping without mentioning anything by taking the approval letter and wait for your approval and once your husband gets his Card, you can raise an inquiry with VSC saying that your Husband who is depend has been approved and received his Card, where as you being primary is not approved yet and ask them to explain. Since it was there mistake to approve the derivative without approving the Primary, I am sure they will just approve yours without questions...........
So basically use your judgement and act and don't worry as whatever has happened is for your good and take advantage of this situation. Good Luck!

I had a similar experience.

My two youngest children were approved about 6 weeks before I was.

They had received there Green Cards in the mail before I received approval e-mails for me and my wife. That's not supposed to happen, but it did for me.

My two oldest still don't have their approvals over 5 months later. I just applied for EADs and AP for them because the old ones were running out. I was secretly hoping that the EAD/AP applications would spur VSC to approve the 485s. No such luck. They just got their new EADs and the LUD was not touched on their 485 applications.

I'm the primary applicant. I have four children and a spouse.
Four of us are approved and 2 are still waiting. I'm 2/3rds approved.

I'm not troubled by my own status as I think it will sort itself out in the end. But I am troubled that the same bureaucracy is in charge of finding immigrants with criminal intent. It's not very encouraging to see that the system is incapable of even keeping related files together and follow simple process rules. Because of this I doubt it provides even the smallest protection against persons of bad intent. It appears to have devolved into an organization that pushes paper poorly and is lacking in fundamental measurements of efficiency or fairness. There throughput measurements they do tout are not meaningful and manipulated for political purpose. I don’t doubt that the staff is heavily burdened and unhappy. This is not a problem of the staff but of the senior people in the organization, who seem incapable or unwilling to correct obvious problems.

It happened to somebody else in this forum, just search the string "primary approved".

Your case also might have approved, just take infopass appointment and check with immigration officer while your husband go for pp stamping. It happened to me.

Infopass without approval letter?

You mean even though I do not have any approval letter to show to immigration officer, you think I should book an infopass appointment together with my dependent that got approval letter?

Do the officer have a way to check my status and see if I am approved or not. Are they not going to frown at the fact that I booked an infopass appointment with them without an approval notice to show them?

Will the officer have access to an up to date database to check my status and see if I had been approved...

Please clarify, and thank you for this suggestion.

I am in the same situation

My case was local office (Stpaul MN) transfer case from NSC. Me and my wife had interview on oct 27 ' 04. The case was not approved during the interview because my name check was pending. But later my name check was cleared on Feb 18th, 05. Yesterday (apr 01, 05) we received 3 approval notices for my wife!!! Since it is local office transfer, my case status is not updated in the website also (that's what I heard too)...

I don't know what to do??

My Son's GC was approved on March 05...Me and my wife are still waiting.... anything could possible with USCIS...I called USCIS two days ago...They mentioned that our name check was initiated in March 05...Waiting for a response from FBI...we all need to pray GOD....
 
An update on my similar case

I had applied for AP and EAD for the two kids that were still waiting. They needed them or we would not be able to travel and the second one is turning 16 in the summer and having a SSN makes things much simpler.

I was hoping that these applications would move along the 485 applications.

Anyhow, last week I got 4 emails and was thrilled becuase I thought they may have approved both kids. However, all 4 e-mails stated my daughters 485 has been approved. The next day In my mailbox I find the AP's for both kids in. Of course the AP for daughter is useless becuase of the 485 approval.

So now I have approvals for 5 of us and just my son's case remains.

It's progress.
 
Primary Finally found out was APPROVED together with Dependent!!

Hello All,
Thank you to all who contributed on my thread of “Dependent approved, primary pending” My dependent was approved March 23.

After a few days wait, I asked my company lawyer to call USCIS to inquire about my case. On April 6th 2005, the lawyer contacted USCIS on my behalf to inquire about my case. To my surprise, the lawyer was told by the Agent that my case has also been approved since March 23, and that they did not know why the approval letter did not go out.

Anyway on April 8,2005, I was told another approval notice has been mailed out, which I am still expecting.

Advice from me to anyone in this type of situation, call USCIS to inquire about your case right away when you see your dependent being approved. On my case, I waited almost 3 weeks after my dependent approval, b4 I got to know that I have been approved also since March 23!! And during all these waits, no LUD changes, no email. Up till today, my online status is still saying “we received your response to RFE, it is taking 500-700days to process this type of case …..blah, blah……

I will not go without acknowledging all you wonderful people that shares your ideas and thoughts freely with me during this turbulent 3 weeks of anxiety concerning my approval. Your advice, ideas, and suggestions kept me sane when I almost went insane thinking of the worst. I say thank you to you all, and may all of you get your approval very soon.

AD - for both 3/23 only dependent approval mailed out and was received. primary has no idea she was approved....
4/2005 - after 3wks anxious waiting, primary call USCIS and got to know she was also approved 3/23 no LUD changes, no update to online till this moment of writing.

4/2005 ---- END OF GC TORTUOUS JOURNEY !!

I'm glad your journey is almost over and you have found sucess.

If you are getting stamped in Boston, take the earliest infopass appointment you can find.

The inforpass system is better than lining up outside but they don't really stick to the times. The system has more or less replaced the outside Queue. the earlier you get there, the closer to the front of the queue you are.
