Dependant I-485 Birth Certificate Question

I have been a close follower of this forum but never really had the need to ask for help up until now. My situation is: I received my GC through work about two months ago. The process went very fast (6 months) under EB-2 category. My husband though received an RFE to resubmit his birth certificate due to the fact that the gender wasn’t translated (husband born in Romania). We send back the translated b. certificate over a month ago but still haven’t heard back from the USCIS. Today we called the 1800 number and the nice lady told us that there has been an error in the FBI name check and that my husband’s file will have to go back to name check. My question is if anyone in this forum has ever gotten this kind of answer and what should we do next?

i think you don't have to worry. since you already recvd your GC its only a matter of time once the name check gets completed for your husband. it takes 3-4 weeks in my opinion to get the name check done.
once the name check is done your husband will receive his GC. you are not going to get caught in any other issues (if it is it might be procedural issue with respect to your case, more documents...etc etc).

I would strongly suggest try calling them.


Also, do you know what they do to verify the date of birth etc? Do they call the passport authorities of your native country? If that is what they do, then it all depends on how slow or fast those authorities are in your native country. In my country, they are VERY SLOW.

I called VSC and was told that my husband's case went to security check and that they can't tell me how long it will take to receive an answer. If the FBI has to wait for an answer from the passport authorities of my husband's native country than we are in for a long long wait.

Is there anything we can do to expedite this process?

I think the two are independent, especially if the two of you are from different nations.

Name check is done for every applicant. As you are prime applicant, so your husband has to wait.
Challange is wait time.
 
LUD on my husband's case

Just witnessed a LUD on my husband's case. This is after 3 months since we sent the translated birth certificate to USCIS.

Is this a good sign?
