Denver DOL

I have been trying to reach the Denver DOL AVM no 303-844 1674 and the no doesn't seem to work. It just rings for ever.

Does anyone know the DENVER DOL's AVM no... My LC is forwarded in the first week of June and and I am waiting for the DOL's approval... Any idea when to expect. (The processing time shows May 2004)

Anybody got any recent approval from Denver DOL. Mine RIR/EB3.

No AVM

My attorney told me that they don't have an AVM. They do have a number for the attorneys and companies to get through, but they won't accept calls on cases which are not overdue yet. Hang in there.

Kv2002

Hello KV2002,
I am looking for an employer who can file labor from Montana / Denver. I am on a long term project and can shift my H1. Could you please let me know your employers contact. Please email me at startdsl@yahoo.com

Thanks in advance..

KV2002,

I am also in the similar situation, my case is forwarded to Denver DOL by 2nd week of June' 04, not heard yet. Please update, if you have recieved any response on your case and will do the same from my side, if I hear any !!.

Thanks.

certified

The companies attorney received the certified job offer from Denver 5 weeks to the day after it was filed with ND SESA.
It was EB-2 RIR (non-IT)

I wish you well. I hope you don't have an IT job, that could really throw a wrench into the process.

Kv2002,

It looks like Denver AVM is working now. But when I tried through my employer's phone number option (as I dont have the case number available with me ), I did not hear about my status, whatever I have heard were the old approved cases. Please let me know, if you could get your case status through AVM.

Thanks.

No

Never checked, left it to the lawyer.

Are you sure your case is in Denver ? As you probably know, some of them are sent to Dallas, of all places.

Is your emp phone no same as in the application?

Thanks Subbu,

The AVM works perfectly.

I checked the AVM with my employer's no today and it says the application received on June 14th was certified yesterday. I don't know what is my case no. So I am not sure is the case is mine or someone else is? It is very much possible my employer has more than one case at the sametime.

Is the DOL receipt date is same as SESA forwarded date? Mine was forwarded on June 9th, but the AVM says the case was received on June 14th.... Don't know why?????

Subbu the phone no you key in should be the same as in your application. I am sure you did the same, but just a thought.

Kv2002, hadron,

I have confirmed with the Attorney that, the SESA approval letter mentioned that my case is forwarded to Denver DOL (Hope that is true to the fact, else if to Dallas.....I better stop dreaming about GC !! :)). And, I have written an email to the Attorney, Is the employer number, the same as I have checked ....and one more question to you guys...Have you checked the AVM, before your approval, like the application is recieved on such date and not approved yet....??. Is there a possiblity AVM messaging would be updated only after the approval !!!??.

Thanks

tried but wasn't succesful

I could never check because the AVM never worked. Only today it is working. If your lawyer says it is forwarded to Denver then it is with Denver. I am now sure that you will see your status only after approval.

Keep your fingers crossed Subbu. I am yet to confirm my case with my lawyer.

Thanks Kv2002. Congrats on your approval. There is no other way but to wait and see how my case proceeds

p.s: When you were checking your case status today, did you hear that, for any other (of your company) were forwarded to DOL and not approved ?. I couldnt confirm thru my company phone number info., is because I am the only one applied in Colorado.

No..

HI Subbu003,

Actually only one case was listed under my employer's ph.no. But I am pretty sure the AVM will list only approved cases or cases with problems (NOF). So no news is good news. My guess is that, you will get yours next week...

Please update once you get yours.

Thanks Kv2002. Hope you are right that I hear some good news next week !!! , I will let you know the status as I hear anything. Hope you are busy preparing the paperworks for the 140/485 filing. Good Luck !!

My LC is forwaded to Dallas

Hi KV2002/subbu03,

Can onyone let me know your LC is filled in IT or non-IT. My lawyer told my case is in IT category and went to Dallas DOL. Am wondering what would be the difference between IT and non-IT. Really I would apprrciate your updates on this.

Congrates KV2002 on your approval.

Thanks

IT/non-IT

This is what I could gather from the rumor mill and some memos I found on the different websites:

The Denver office has such a low volume (compared with other places) that they don't have a director level person. (edit: they don't have a 'certifying officer'.)
So, the only RIR cases they can approve locally are the ones that have no 'issues' whatsoever. Some lower level office 'ant' checks whether the appropriate ads were run and whether the qualifications match and 'rubber stamps' the application.

Now, with layoffs in the IT industry 2-3 years ago and all the political brouhaha about outsourcing/H1/L1, IT is considered an 'issue'. So basically they can't approve many RIR IT cases without overcoming a higher standard. A higher level person has to sort of 'override' the 'issue' of IT. (remember the 'blanket RIR denials' for IT folks in Boston). So, as they don't have someone with the appropriate 'rank', they just send the whole case to an office that has one. (Why in the world they chose the regional office that is the most swamped to start with, is a mystery to me. But so are many things in the immigration process.)

Again, these are not facts that I could proove with references/citations, this is how I understand it from bits and pieces I could gather while looking at the entire labor cert process.

My case is actually RIR and IT. Filed in Colorado.

Good luck to all you guys... Hope all of you get your LC's faster.

Actually this forumn is a wonderful place to gather info....!!!!...

HI Hadron

Thanks for your information. I do think the same way.

guys please update any one's LC also went to Dallas instead of Denver.
Really this is a wonderfull forum to share these type of information.

Approved !

My labour is approved by Denver DOL per my attorney's email today. It took
4 weeks at DOL, after it is forwarded from SESA. Its a big relief afer years of waiting for this day !!. Ofcourse, I have to wait some more years to see the real outcome !!. Hi, Kv2002, have you finished your paper work for the concurrent filing ?. By any chance, anybody going for CP while in the 7th year of the H1 (I am in the situation, contemplating a CP?!! ) ?.

Good luck, for the rest who are waiting for the labor approval.

I am sure, Denver DOL is really doing some good speedy processing. And, looking into my case (Non - RIR, EB2, Limited Reiview and field is IT), I dont think all the IT (Non - RIR) cases are forwarded to Dallas.

Thanks.
