Denied visa and banned for 5 years with on explaination

Hey guys,

I would really appreciate some help. Two years ago I was issued a TN visa and was working as a management consultant with a company my dad was starting. A year later I went to renew my visa to find myself searched, interrogated for over 8 hours, insulted, then banned from the country for 5 years for no explicable reason. I was never provided a reason why I was denied my visa or why I was banned.

I've not only lost my only source of income so I can't afford a lawyer. The company I had helped build for my father fell apart without me. The worst part of it all is that I am not even able to visit my family, whom I am incredibly close with, as they are all American and I'm stuck in Canada.

I was found inadmissible to the U.S. under section (7)(A)(i)(II)

The written explanation is.

1) You are not a citizen or national of the united states

2) You are a native of IRAN and a citizen of Canada

3) You are a immigrant not in possession of a valid unexpired immigrant visa, reentry permit, border crossing card, or other valid entry documents required by the Immigration and Nationality Act; You are unqualified applicant for admission as a management consultant to ****. Which is owned by your father. You also have a pending immigrant petition on your behalf filed by your sister.


I was banned under

*For a period of 5 years under section 235(b)(1) or 240 of the act


I am fully qualified to be a management consultant possessing a Bachelor of Commerce, a Marketing Management Diploma, and have over a year of consulting experience with SCORE. I requested a court date with an immigration judge and they basically laughed at me during the proceedings. I was degraded in front of everyone, photographed, finger printed and was threatened with imprisonment if I didn't comply with it all. I'm not trying to pull the race card here but for some reason I think this may have something to do with me being born in Iran.

Please help. I'm out of options and have pretty much lost all hope.
 
Seems like you have 2 problems; one your sister has filed an immigrant petition for you therefore you cannot be admitted under TN since you are a potential immigrant. Secondly immigration officials do not believe that your job and your qualifications are legitimate.

TN is not a dual intent visa, i.e. you will have to satisfy the immigration officer that you don't intend to immigrate to US. Since your sister filed a petition for you, it is almost impossible to overcome immigrant intent.

An option for you is to try and get an H1 visa if you can overcome the issues with your job/qualifications.

He's got a bigger problem - he appears to have been placed into expedited removal and barred for 5 years. The I-130 isn't a show-stopper; being hired by one's father as a management consultant clearly was.

Time to see an attorney. The 5 year re-entry bar needs to be overcome first.
 
I wish I could afford a lawyer. I'm pretty much on my own for this. How can I overcome the 5 year re-entry ban? That's my biggest problem, the company has since fallen apart since I left and no longer exists. I just miss my family and it kills me to not be able to visit them.
