Denied Job Inspite Of Having Ead Card Why????

hey folks
i am one of them applied for an Ead and recv the card all ok have my 485 going on its own course .... I140 cleared
i had applied for a banking job of course its an entry level position too all went ok interv etc was called given an offer and started with training
the next day i had to submit my EAD card and SSN card showing that i can work here ...that day the HR looked at that took my fingerprints too all 10 fingers in diff angles as all job must have done a credit check too i dont know i am all clear i have no issues here
next day i recv a call and am whisked out of the training saying that in ur application u checked marked a column that said applicant for temporary alien /something like that ...and ur documents that is EAD card and form I797C dosent match with that ..... what u checked marked
it was so shocking to me well .......

all i wanted to ask is y r they declining me ????? i have the documents to prove i can legally work in the US ....
is there any way for me to convince them and prove them that i may not have GC / whatever but i can work and keep renewing my ead all time ????????

PLS HELP and just because i got this job i had declined all other offers and now its damn hard to go back and start again??????what can i do??????
 
Everyone's case is different, but in my case the job offer/contract came first and then visa related paper work came next. That is, my employer offered me a job knowing that I was a foreigner without GC. And I accepted the job offer on the condition that my employer would sponser my h1b and then greencard applications.

Of course, not being a permanent resident could be a huge disadvantage in terms of getting a job, getting promoted, etc. But if employers hire us with the knowledge of our nonimmigrant status, why something like that -- i.e., turning you down during some training session -- could happen?

Your case seems somewhat out of order. Is this employer the same as the one your i-140 was based on? Or are you talking about your second job?
Or perhaps, your employer somehow changed its mind about hiring you, but cannot find a legitimate reason to terminate you, thus using your status as an excuse? If that is the case, it is so annoying, but workplace problems like this certainly do exist.
 
Are you sure that the job you got had no pre-requisite condition like they needed only PRs/Citizens ?
Check with the original job posting and see if something like that was mentioned.

Maybe something to do with security clearances ??

Am just throwing some ideas as I don't know your exact situation.
 
I would consult a lawyer on this one. But first you have to find out the exact details of what you had checked on the application and why was it a problem when you showed them EAD. Get as much details as you can. No employer can deny you employment on the basis that EAD is not valid for work. If that is the case you may have grounds to sue them and they may have to pay you damages. Don't let this incident go away quitely.
 
I agree w/ Serta .... but you need to make sure what you had said in the application form.

If you had made a mistake and the form was signed by you (maybe "under the penalties of perjury" clause), you may not have much luck purusing legal action against the company.
Make sure what you do won't backfire on you !!

Try to get copies of all the forms that they used and take it to a good attorney for advice.

hey guys thanks for all the advice but look like i made a mistake i clarified and realised that i had checked marked a column which said
US CITIZEN/PERMANENTRESIDENT/ASLYEE/APPLICANT FOR TEMPORARY RESIDENT ALIEN

YES OR NO
I CHECKED YES BOX .... AND THERE WAS OTHER COULMN WHICH SAID OTHER AND BELOW IT SAID SHLD HAVE PROOF OF EMPLOYMENT IF CHECKED THIS

I THINK I MADE A MISTAKE NA..... CAUSE I AM AN APPLICANT FOR greencard WHICH I BELV IS CALLED AS LEGAL PERMANENT RESIDENT NA.....AND I TICKED THAT COULMN THINKING I AM A TEMPORARY RESIDENT ALIEN

I CANT DO ANYTHING I THINK ..... OTHER THAN SERACH AGAIN .... MAYBE DESTINY DIDNT WANT THINGS

ANY MORE ADVICE I WELCOME THANKS
