Denied Citizenship

I work for GLS / L-3 Communication since 2006 as a Linguist for the Military under a contract. I am holding a Moroccan Passport with a Green Card. When I started working for this company, we are allowed to go back home (USA) every 6 month,we fly from Baghdad to Kuwait City (Ali Al Saleem US Base) in a US Military flight, and then from Kuwait to US, at that time we never used the passport to leave the country we use it only when we enter the state but from Kuwai we use only the CAC Card (Gov Badges) but when I applied to go on Vacation they changed the rules they came up with the new rule that we all need to get Visas from Kuwaiti Government to go back to the state through Kuwait but only US passport holders can go through there but other nationalities they are not allowed at all and there is no other way, as I remember my old Site Manager told me, I am stock in here utill they find a way for all the linguists here who are holding other passport or travel documents, so I had to cancel my vacation, after a while they opened the civilian side of Baghdad International AirPort. My company told me if I chose to fly from there it will be under my own risk, because that side of the airport is not secured by Americans and I am not an Iraqi and I am holding a Moroccan Passport, I didnt want to take that chance because I might be kidnapped or killed if I fly from there. then they opened a gate through Jordan and that is when I came back to the state on Vacation and up to now I have to request a visa each time to fly back to the state on vacation so I can go through Jordan.

Now I would like to appeal my case because I really do have a reason for staying that long in Iraq, and I was working and I have been all that period with Americans I was not in an other country. and I mentioned the reason for staying there, I didnt want to put myself at risk coming back on vacation.

Please tell me what do you think about this? do you think they will grant me the citizenship? Can you please give me some advices? I am really lost I dont know what to do? specially for denying it for me and I have been working for Americans and Suppoting the troops here.
 
I have no idea how I can help with this case. You should seek the help of a good attorney to help you.
 
yes he is a US Contractor. they denied it because I stayed working here for over a year straight without going back to the state.

"He" is a US military contractor? I'm talking about the company, not any person. Did you present clear evidence in the interview to show that your employer is a company contracting with the US military?

You are not explaining yourself well here. When I read your first post, I only saw rambling details about Kuwait and some vacation and couldn't follow what your situation really is about. You should have just gotten to the point and said that you were contracting with the US military and were overseas for more than a year straight, and they denied your case for being outside the US for so long.

If you were this unclear in the interview, it is not surprising that you were denied. When you have a situation that puts you at risk of denial, such as extended absence from the US or a criminal record, you have to present your case very clearly and strongly on paper and in speaking to convince them that your naturalization should be approved. So please give us a clear picture and maybe we can provide some helpful information.

I have been an employee of GLS/L-3 Communication (It is a US Company contracted with DoD) since 2 October 2006. I havebeen employed by GLS as a Linguist for the US Military.

I have been working in Iraq for over a year with no time off. When the company received this contract plans were in placed for all personnel to be able to travel back home for vacation. This has been a task which the company did not anticipate due to me having a Moroccan Passport. I was not able to travel until I received a Travel Document from the United States. I was instructed to apply for the Travel document which I did. Once the document was returned it was the wrong kind of Travel document.

I Could not travel due to the fact that I did not have the correct document which was required by Kuwait Authorities. The only way I would be able to travel would be through Baghdad Airport. This would be very dangerous due to the fact that the military did not have security emplaced at this airport.
 
Yeah I did keep my green card, I did file taxes with my husband all these years and I am still doing it.
Was your husband living in the US while you were away? Is he a US citizen or green card holder or in the US on a temporary visa (like F1/H1/L1)? Were you maintaining a house or apartment in the US? Did you prove to the interviewer that your employer was a contractor with the US military?

The problem is that you are distracting us (and may have distracted the interviewer) with a bunch of details about your passport and vacation and all that stuff. Your focus should have been on showing that you were working for a US military contractor. Once you establish that fact to their satisfaction, you don't need to confuse the issue with stories about travel documents and whatnot, because time spent with the military or their contractors is generally considered to be time residing in the US.

Anyway, if your employer was indeed a US DoD contractor you should have a good chance of winning the appeal, assuming that you gather all the relevant evidence and get a good lawyer.

I wrote here the details so you can have an idea, because now when I appeal the case I need to give them the reason for staying overseas that long.
my husband is a US Citizen so does my daughter. I own 2 houses and I do have all my bills under my name in the state, I own Vehicles and so on.

I am sorry if I confuse you here, but I wrote all that just to get an idea for me staying overseas.

It's surprising that she would deny you while knowing that. Time to get a lawyer ASAP for the appeal. There is a tight deadline if you want to pursue an administrative (i.e. non-court) appeal.

I need to know about this appeal, they sent me Form N336 to fill out if I want to appeal my case, I was thinking to do it myself without a lawyer because I cant find a lawyer in St Louis.
when I appeal the case, if the hearing will be in the court or I will have an other interview with the same Immigration Officer? do have an idea about that?

I storngly advise you to get lawyer without any delay. Forget it to try to handle this appeal by yourself. I dont find you quite competent to attempt it, and may be agaist your own interest.

I find one Mr. Timothy Wicher at site www.immigrantlawcenter.com who is in your city.
You can also get alawyer from other cities such as Indianapolis , Kansas City, Cincinnati or even N.J. , N.Y.
From your background , you are well established and can afford a lawyer, so don't risk your case.

Thanks a lot for getting back with me, I am willing to hire a lawyer but the problem I coudnt find one, but I will look for it in the sites you gave me.
I have a quick question, if I hire a lawyer from an other city, he or she still can represent me here in the state? how does it work? also the appeal, is it an other interview or it will be in the court ?

If you take a lawyer From other city , you will have to go to hiom with all details and papers, documents for a personal meeting. He will prepare an Appeal and have it filed dirctly , online or through another associate . You don't have to worry about all this. You suddenly want to know so many things so late in the game. You rather leave everyting to a lawyer.

I still have 3 weeks, because the denial was send to me on 08/21/08. My problem right now that I am in IRaq, and when ever I call a lawyer they dont get back with me. that is why I am asking questions in here. I am willing to pay what ever it takes to get my citizenship.
 
When will you be able to go back to USA ? All you do is to find few good lawyers and call up to fix an appointment for a meeting as soon as you are to be back in USA. If you cannot go , your wife or friend can go with all the papers. If you cannot call them up from Iraq, your wife from USA can do it for you more easily.
If you decide to get lawyer from other cities, I may be able to give you my experience with few. But first preference may be someone from your own city .

Thanks a lot for your quick reply, I will ask my husband to go and check with other lawyers, and I will try to call them again from here. I wont be able to go back to the state for vacationt ill the 29th of this month, and I have to submit for the appeal before the 21th.
I hope I can get this citizenship, I feel I dont deserve to go through all this.
