Denials and Nafta info

Hi

I have recently been denied twice for TNs after living for years under TN status in the states. They both allowed me to withdraw my application 1) 214b (ties not strong enough in Canada) because I admitted to not renting a place in Canada 2) 212a7AiI - something about not having qualified - something I can clear up.

I am now going to apply with a very large/different company and am making sure I have all of my facts as most know, everything is subjective depending on who you get etc. Where can I find the actual NAFTA TN visa information?

Also does anyone have any experience being denied and then applying with another company?? I haven't even been allowed to go back down and have Most of my belongings in the US - its totally sucks!

In the interim you should not have problems entering in B2 visitor status.
 
Have you returned a second time, or did you immidiately try get visitor status upon denial of your TN status?

When you cross the POE you can only claim 1 status per crossing. You chose to claim TN status. You were denied. You cannot at that instance in time say that you want to claim B2 status, since you already attempted to claim TN.

To claim B2 status, you need to reenter.
 
Hmmmm - well I just applied again for my TN and was refused AGAIN!!! Now I just want to go get my stuff - I"m tired of the whole process. They talk about proving strong ties if I do come down as a visitor - I dont have a lot of assets up here, but I do have letters of support (20 from friends and family in Canada) - I have a letter of employment from someone up here and a bank account - do you think this is good enough?
 
I've been Rejected and got TN 2nd time

Hi I 've been rejected as my employer has home office, they will not Issue for Home Office ...and I was given 3 days to leave US.. I have returned rental car and left 2nd Day ( Detroit Windsor POE), Immediately I called my Vendor for letter... I got the letternd tried through Buffalo POE..After a long wait I was called and POE verified letter and granted TN..

I know how bad it is .. I am well settled in US and my family is in US... I thought I will never see my family...Take Zucarros's help, He is a wonderful attorney, I called him Mr.Zucarro guided me very well.

When they ask for your address (I forget at which point) are you providing an address in Canada? I used my parent's address.
 
I was not asked for Canada Address

I was not asked for Canada Address, Even if they Ask I have no address, I am lucky > :confused:
 
I thought proof of Canadian residence is NOT required when renewing a TN?

Hi!

I cannot afford to rent 2 apartments at the same time, so I had to give up my old address in Canada. Does this mean my TN renewal will be denied if I state this fact at the POE? What about if I just apply by mail --- will I need a Canadian address in order to successfully renew? I have a relative who lives in Canada --- can I use her address?

Please advise. Thanks!

Is Mr. Zucarro an immigration lawyer? How can I get hold of him? How much did you pay in total? Thanks in advance..
 
you need to give a non-US address on the mail-in form. use a relative.

Where on the I-129 form one needs to indicate a non-US address? I tried to find it but it looks like they only request a US-based address for a person for whom the company files the form.
 
You're right, Gunt. It says in the I-129 form Part4:

"If the person named in Part 3 is outside the United States or a requested extension of stay or change of status cannot be granted,give the U.S. consulate or inspection facility you want notified if this petition is approved."

Office Address (City) U.S. State or Foreign Country
Person's Foreign Address

Sounds kind of misleading to me.... If the person is already in the US and the company is requesting the USCIS to extend his TN stay, does this section still needs to be filled out?
