Delays Due to Religious Worker Deadline

I think no matter we submit a petition or not, 485 cases will not be processed till Oct 1 2003, BCIS already made that decision. We should not expect to see flood of approvals till end of Sep. Right now, BCIS is processing I-360(religious worker) with Nov 2002 RD and adjudicates I-485 for them.
This decision has been made by BCIS headquarter so there's no way we can ask for expedite of our cases.

However, the TPS program has taken many adjudicators away. We should ask for higher priority than them, otherwise we can do the same thing, file a lawsuit.

Since BCIS is not going to move in these two months, we should ask them at least sending out second FP notice for applicants which will have or already have FP expired.

In our petition, we should emphasize we have waited for a long long time and during 2 years of waiting always Government decided to expedite other type of cases. and the processing time has grown from 10 months last year to 2 years. That's outrageous.

Why religious workers need immigrate to US not to heaven remains a mystery.
 
VSC not affected officially

Based on case scanning these days and rupet updates, we can say VSC is doing same thing, cut 75% officers from EB 485 cases. That's why it has been so slow since June 2003.

However, I think it will be back to normal processing speed probably in late Sep. When VSC feels it has almost finished all religious workers cases, they will gradually shift adjudicators back to EB 485.

no loose hope , atleast we can submit the petition ,may it lie on their table we will start follow up. atleast we do our part.

So at least they know we as a group are united and won't
tolerate further backlog delay. I hope in the near future those
kind of shift forces to do other cases will not happen.
 
I believe we should focus FY2004.
The most important thing is whether the BCIS can get enough FY2004 budget to assign reasonable number of officers to adjudicate EB I-485 cases or not,
and that those officers will not be taken away to another categories through FY2004.

I appreciate your efforts regarding case status at CSC forum. I'm happy that you are here at VSC forum.
As you said budget is the root cause of all this issue.

Religious workers are immigrating to "haven on earth". Do you know that their respective churches provide board, car and all the perks? They also have powerful lobbies and they can get ahead of us. Even Congress did not forget them. Before even the "sunset" they already have a bill for extension. After this one is done BCIS will find something else.
Let us get the petition and then follow with a Class Action Suit: The immigration numbers are not allocated - as simple as that - in this respect the less aprovals for this fiscal year the better.
Is there any simple way to find the approval numbers for EB I-485 for the last two years? I believe that where we should start. We also need support from AILA and AILF, if willing to help.

I believe BCIS is just looking for ways to delay the process.
Last two months, their reason was the TPS or the reassignment of the adjudicators to help in the registration of people coming from the middle east. This time, its for the religious workers. After this, when September 30th arrives, they will have their annual audit, and that will delay the processing for another two months. Which I believe for a regular adjustment of status to be processed now...i would say, 2 years.
 
We should all be united and demand justice from BCIS.
1. Let's focus on submitting the petition now. Let's think about how we can mobilise thousands of people for the signature phase.
2. Once the petition is submitted to Mr Khatri, let's try to get an appointment from him so that we can personally talk to him. Let us ask him to arrange a meeting between us and BCIS
3. Let us hope that every thing goes as per this plan and we will be able to meet BCIS higher officials and discuss about reducing the backlog.

We can think of class action if BCIS does not co-operate with us during the above process.

coming to congressional lobbying, I am little hesitant towards that because in this tight job market, i don't think we can have any bill passed in our favour. The labor unions and anti-immigrant lobbies will get energised and further complicate our problems. Publicity(to Americans) is the last thing we want.

you are 100% right. That's why we need to stand up and fight.
 
oh dsatish, did you mention in the petition that we would like to arrange a conference call with the ombudsman?

The last point (point 10) in the letter says that we want the feedback from him. we may not need to write about conference calls in the petition. It is better to meet him in person or let Rajiv talk to him and arrange a conference call in future.
