Delay being approved after appt. with immi. officer.HELP!

I wen to my interview withthe officer of immi. in Agust 2005 in Atlanta, GA.
He congratulated me. But, i haven't received any letter, neither the GC. Online it doesn't show as the case has been approved.

How long it takes to approve the case after memting with the offcier? What can I do?.

I am in the same boat as you.After Interview officer showed me welcome letter etc and congratulated me and this was more than a year ago.
However my 485 is still pending.

Usually that will be the case if your security checks are pending OR no visa numbers available(priority date).
 
You guys are scaring me. We had our interview two weeks ago and the officer told us that we should expect our cards in the mail within two months. I asked if we were all done, and she said yes! I hope I won't be waiting for a year!

AtlGC, Did the officer stamp your application with the "Approved" stamp? The officer stamped our applications infront of us.

I dont think you need to be worried just because mine and someone else's had some issues. Is your 485 approved? Did you get approval notice?
Usually either they would stamp your passport right there or atleast approve your 485 on the spot and order your card.

In my case, the officer did paperwork for approval but thats all their internal paperwork and I didnt get anything from the officer regarding approval. He just told me about it and took my FP and signature on 551.

So mine may be very different from yours.

Actually my case is exactly like yours! The officer took our index finger print and signature. She stamped our paper work with "Approved 3/8/06" and she said wait for the cards in the mail in the next two months. I don't actually have any proof that our cases were approved!

Why would the officer tell me to wait within the next for the card within the next two months if our seurity checks arn't done? I hope I'm just paranoid!!!!

Your case may be different from mine but i am stuck in the stupid Name Check and your case is very similar to mine for the interview part though.

Did the officer actually stamp your application "Approved"? She stamped each of our applications 3 times.

I'm going to wait a couple more weeks and then I will contact the Seattle local office.
 
FOAIP- Law suit

Hi,
No the officer didn't stamp my passport, neither I received welcome letter.
I am looking to file FOAIP or file law suit agains timmigration.
Any advice??????

The officer told me the case was approved. Tha I was going to get my GC in 2 months. He told me the only thing you need to do is to take your FP again. And the FP were sent back to immgration 24 hours later.
It is my understanding that Immgration has to approve or deny the case after interview and no more than 120 days after. I have read cases of people who file lawsuits agaisnt immigration and they get their GC.
 
What was asked during the interview

Hey Mr. Green, what did they ask you during your interview? Were you on an H1 status with the employer who petitioned you? What did you have to bring to your interview?

My interview was taken in Feb 01, 2006 at local office. The office told us that she has all the docs , they will make a decision and get back to me. She also said she also needs to check about the visa number availibility. When I asked her a timeframe when we will get a decision , she said she can't give any timeline for this.

When I called my state senator office she said that they can inquire after 120 days ( as you mentioned ) . If what you said is correct, why the officer told us that she can't give us any definite timeline about the approval.

Can you post some link to the thread where you saw that 120 days is the official timeline to give a decision on the case after interview?

I do not think the 120 days rule always applies...my case was approved on March 21, and interview was on June 8, 2005. And I know a person with interview in April 2005 still waiting for approval - because name/security check was not cleared at the time of interview.
 
if your PD is current, how long does it take to get approval considering other fact such as NC is done already?
 
File lawsuit

I am planning to file a lawsuit agaisnt immigration. They haven't approved my I485 after my Interview in August 05.
This is what I found
INA: ACT 336 - HEARINGS ON DENIALS OF APPLICATIONS FOR NATURALIZATION

Sec. 336. [8 U.S.C. 1447]


(a) If, after an examination under section 335 , an application for naturalization is denied, the applicant may request a hearing before an immigration officer.


(b) If there is a failure to make a determination under section 335 before the end of the 120-day period after the date on which the examination is conducted under such section, the applicant may apply to the United States district court for the district in which the applicant resides for a hearing on the matter. Such court has jurisdiction over the matter and may either determine the matter or remand the matter, with appropriate instructions, to the Service to determine the matter.


ANY ADVICE ON HOW TO FILE THE LAW SUIT?
In Atlanta they are working on cases filed in 05. Mine was filed in 04, So it is not a matter of visa available.
ANY ADVICE???????????? :confused:
