hi, I have applied for change of status from B1/B2 to F1. I have few question. I would appreciate if some one could answer them.
1) If my change of status is approved after the joining date then what would I do. Can I swithch to some other program like kaplan english language program untill next year.
2) If I defer my admission for next year while my change of status application is pending then what would be the status of my change of status application. Is it possible to defer admission and go to some other school if change of status is approved later on.

thanking every one in advance

COS from B-1/2 to F-1 is not easy as the others. Did you inform the admitting officer at the POE of your intention to seek admission to schools and join one?

I told them that I came here for admission interview, but my I-94 is not annotated as prospective student. I showed them the invitation latter from school. I saw one of the lawyers saying that I-94 annotations have no value, IO have been told not to annotate I-94, but they still make such annotations like extension not allowed/ no change of status allowed etc. In the same way I think prospective annotation on I-94 doesn't make any difference unless some ones B2 visa is issed for that purpose and mentions ''Prospective student'' on visa, and such visas are difficult to get.
I asked the same question in Rajiv's conference call and he categorically said that change of status from B2 to F1 is not possible, but I have seen several ppl who have done that recently. There was a proposal back in 2002 that COS from B2 to F1 shouldn' be allowed, but it never became a law, so there has been no change in law, it's only the intent part that could cause denial. I have been told by kaplan that 9 out of 10 cases that they send get COS. I got similar answer from another school aswell. If COS was not possible why would schools misguide their students.
I don't know why there is so difference in opinion among lawyers, schools and the ground reality.
I personally think that COS is possible if application is properly prepared and lately filed in I-94 period.

In addition I told the IO that what does I need do incase I get selected in interview and decide to enroll. I was trying to make him annotate my I-94 as prospective student. He thought for a while and then said you will come back to us.

I do not believe it is possible. And specially the part of the lawyer saying that the POE officers annotations mean nothing... I would like to see an I-539/I-485 approved petition, with an I-94 marked No AOS/COS/EOS.
