December Visa Bulletin??

here is my take on the source of the rumor: if you check the poster's PD in signature which is EB2 Sep 2005, and forward movement of 1.5 years will make him/her current :)

this of course assuming he/she falls under India EB2.

Hi Friens who have been waiting for visa bulletin.

What happend with bullentin, I have been waiting for 5 days. I have doubt about releasing of visa bulletin for this month. If it comes it should have posted by now.

Write any coments about this issue.

That could be him.. instead of calling intuition/prediction he called it a rumor!

Seems like uscis/DOL are thinking hard before they issue one, as laborBadhi said something may be cooking.

USCIS is a bunch of jokers

very dis-organized entity and scewing around with peoples lives/careers and time

why the hell cant they lift the per year quota restriction and approve someones 485 if that person has been waiting atleast 3+ years. 3 years is a reasonable wait to get visa#, if not they should be removed from that bracket and approved and should not have to wait for a quota.

this whole process seems ridiculous

Unfortunately, it's not up to USCIS to decide on per year quotas. These quotas are spelled in the Immigration and Nationality act and its amendments which can only be changed by the US Congress. Any immigration legislature won't pass through the Congress any time soon because of deep division in the House and Senate over comprehensive immigration reform, as any bill on immigration will have amendments intorduced to include parts of the failed comprehensive immigration bill, which will enevitably kill it. Immigration now is too hot a topic for the Congress to act upon before 2008 elections. So we are stuk with current quotas.

However, I agree with your comment about USICS being disfunctional and disorganized.
 
If they had only used the existing quota wisely the situation would not be this bad... they have wasted 10K in 2006, 47K in 2004, and 88 k employment based visas in 2003.

may be we need to change the congress and president before we nee any good news
 
I agree with you in lines of Canada and maybe in near future for EU Blues card, they should grant permanent residency to people on temporray basis and after a person had been permanent resident for say 3-5 years then should be given citizenship.

We are happy to get GCs but the same struggle starts again at the time of citizenship, all background checks and headaches etc.

Any prediction/thoughts for December Visa bulletin? Any hope for EB3-India?

This is a key sentence in the visa bulletin - "The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits."
The State Department does not really care how many 485s have been applied for. All it cares about are the cases that have been processed by the USCIS upto the final stages and are only waiting for
a visa number to be approved. This is the list/report that I guess that the State Department
bases it's cut off dates. So, based on that assumption if the USCIS has sent a bunch of processed cases (but waiting for visa number for approval) in Nov and the case PDs are spread out
from 1999 all the way to 2004 then depending on the demand we could end up with a cut off date of 2002 or 2001 for high demand countries like China,India.

From the lack of date movements in the Sept, Oct and Nov bulletins it appears that USCIS is either sending a very low volume of processed (to completion) case numbers for getting a visa number (much below the numerical quota for the 1st quarter of FY2008) or
USCIS does not have any cases at all for visa number approval.

In 2008 and 2009 we will see a retrogression overing around 2004 and 2005 because

1) Dallas & Phylly BECS cleared a lot of old cases with PDs of 2001 & 2002. These PDs have now entered the 485 queue
and start surfacing as "completed processing but waiting for visa number" applications about a year from now.
2) Since LC substitution was ending in the middle of 2007 there was a mad rush for filing 485 applications with
old PDs. These will also weigh in when they surface as "processed to completion but waiting for visa number".

If logic prevails, my guess is the December 2007 bulletin PDs will remain about the same or advance slightly further because
my guess is USCIS the is not having many 485s waiting for visa number for approval. Mid to Late 2008 and early 2009 will be interesting because of
the large influx of applications from the July 2007 bulletin.
 
EB-2 Retrogression by 2 yrs 3 mo

The Dec 2007 visa bulletin shows EB-2 (Indians) retrogression by 2 yrs 3 mo ... and this is after a lot of people were predicting "forward" movement. At this point the situation looks so hopeless I wonder if someone like me with a May 06 priority date will ever see a green card in this lifetime?
