For me - Lawyer sent 140/485/EAD/AP on 20th December, no new info since them.

I140/I485 - EB2 applied concurrent on 12/20/04 @ CSC.
Recieved notice in today's mail.

Is concurrent processing still on for EB2?
Any one filed during this time received FP notice? Please post.

Received FP Notice in mail today for appointment on 1st Feb. Thinking of doing early FP. Any idea about pros / cons of early FP and FP process?

Did your LUD updated? My receive date is 20 dec and ND is 3rd Jan and I did not receive the FP Notice.

We are out of town on vacation, my friend who is checking my mail called me and informed that we received FP notices on saturday 01/22
 
Does the new rule apply to me?

Does the new rule where the priority dates have been moved back apply to me? My case details are:

LC: Applied on 20/12/2001
LC: Approved 12/10/2004
EB2

I-130/I-485: Received by USCIS on 31/12/2004

Stating the obvious - please take care of your fingures before FP (I had a little paper cut and they asked me to come back after it heals, I guess no major harm done except need to go there again).

Last month I applied for 140/485 in SF using labor substitution (with a labor approved in 2000) and was shocked to see FP notice yesterday since it has PD mentioned as Jan 05. I got a second jolt when I called attorney to know that the 485 receipt also has PD of Jam 05.

My attorney had told me (prior to applying) that I will get PD of original labor. I have my own labor pending with PD of Apr 02. I chose to substitute only for the reason to get the PD of 2000. Now I am in deep trouble.

Attorney says that the rule for PD on substitution is unclear and earlier he as seen people getting original labor date as PD for substitution. He feels that after retrogression California USCIS may have become cautious. He tells me that nothing can be done except to wait till PD of 2005 becomes current (another 3-4 years???). He feels that withdrawing the 485 application (and applying later with my labor) will cause more problems.

I am totally let down and feeling depressed. Same with my colleague who applied around same time and has exact same problem. We feel helpless.

Has anyone recently applied for 485 with substitution (in 2005)? If yes can you let me know the PD in receipt/FP notice?

Please take a moment to help me. I don’t know what my options are.

You are not in trouble.
For substitution cases, the receipt shows the PD of the date you applied.
Only at the time of I-140 approval, you will see the correct PD, which will be the PD of the labor used.
There are lots of cases like this which you will find in various threads here.
My HR and also the lawyer have the same opinion.

Don't panic. You will be fine.
