One of my friends case is transferred to a local center for interview.
I do not have the exact details.

RD= Dec, 2001
Change job -Oct 2002
RFE -June 2003 (employment letter)
Transferred to local center Sep-2003
Case=EB 12 (OR)
Country=Iran (canadian citizen)

Thanks futuregc for the info on your friend's case. I guess change of employment has probably more to do with the transfer than the country of origin because I am not sure how and whether AC21 can be applied to EB12 (OR) categories especially so if the company/university sponsored I-140 of your friend.

EB-OR AC21 is similar

I think that that any EB category may be similar once 180 days have passed. questions were raised for executive people but again they were only questions.
I do not know why OR should be any different from other EB categories. I sti;ll think that he/she should be able to use AC21.

Some argue that since outstanding researcher (OR) category doesn't need permanent labor certification, AC21 won't apply. Again, I am not sure myself and I do wish AC21 would apply to all EB sub-categories.

Then what will happen if they change jobs after 189 days.
I guess EB1 (OR) can change job after 180 fays like other EB.

It seems I was misinformed and ag28 and futuregc9 are right. Here is a link with seemingly an updated piece of information. Accordingly, AC21 applies to all EB-categories plus NIW/EB-1-EA can afford even broader flexibilities.

One of the first I have read that directly talk bout NIW/EB1-EA.
Actually my lawyer had assured that NIW doesnt require job offer. He recommended the particluar area that I should work in if I change jobs so that I am within the purview of the 140. In fact the law office did not even ask me to notify if I change jobs since NIW/EB1 EA are not employer specific.
And lastly, i also got an email from their office that a lot of NIW cases are approved without transfer. The transfers we see on this forum are just a portion of the total such cases, I think.

Thanks a lot ag28 for the update. An attorney from Murthy's firm also replied in a similar way to my similar question posted on their forum. Let's hope for the best...
