Hi,

I bit confused about how much should i recapture. Can anyone help?

My H1B information:

Receipt Date: 01/24/2001
Notice Date: 07/02/2001

Valid from: 07/02/2001 to 01/01/2004

Entered in USA: 09/27/2001

First Extension:

Receipt Date: 12/31/2003
Notice Date: 07/08/2004

Valid From: 07/06/2004 to 12/31/2006

Should i able to recoupe 9months?

Also i am going for 2months vacation from 09/30/2006 to 11/30/2006. Do you think this will create problems while entering in USA as my H1B is expiring 12/31/2006?

Please help me.

Thanks.

The receipt date and the Visa date are not that important, recapturing all days up to the entry into the US should be a slam-dunk.

Keep all boarding passes of you trip, the itinerary, make photo-copies of you re-entry stamp, You can even ask the country you go to to stamp your passport, even if you are a citizen.

The rule is 6 years, and you can successfully recapture every day you did not spend in the US to fill those six years (and that depends on the quality of your evidence, the quality of your lawyer and his spplication, and the disgression of the officer that handles the case).

Good luck
