Date to send/apply for Citizenship

Hi Folks,

I got my Green Card (485) approval on Jan 7, 2005. Based on the eligibility timeline - 4 years and 9 months, what is the earliest/safest date (October 7th 2009?) to apply/post my N-400 application? I read somewhere in the forum that if you send the application a bit early, it might be sent back.

Also, I assume that one month away on vacation outside the country does not apply to the 4 years 9 month rule.

USCIS won't return your application if you send it earlier, they will happily cash your check and reject your N400 application, but keep your money and ask you to file when you are eligible with a new filling feee. If I were in your position, will mail it on Oct 10, 2009 and be happy. A month outside the US will not be a problem, except if you spend that month shouting death to America..:eek:

Nope, you are fine with 4 year 9 months rule... :p If you taxes are in order, nor speeding tickets over $500 per incident, and no dead hookers in your closets, you are free to apply and enjoy the process...:eek:

It is not 3 months but 90 days count before the five year completion. My opinion is, your date will fall on Oct 11th 2009 but I would suggest you date the application something like Oct 14th and mail it on Oct 14th. Few extra days to be on the safe side. I believe any single trip not more than 180 days will not be determined as break in residency. You should be able to apply 4 years, 9 months rule for filing.

You can travel but not recommended.

Btw, dead hooker in closet :eek: is fine too if you can proof it is manikin for educational purpose, and not for pleasure. :D

I believe there is no bar on travelling outside USA after filing N-400. If you do, make sure to mention it during your interview so that the IO will make note of it in the application. The only time I think it is not advisable to go out is between the interview and oath date. Not a good idea to miss the oath letter by any chance.

As long as you don't break the continuous residence requirement (180 days out for the last year on a rolling basis) you are free to go wherever you want.
And I strongly recommend that.
Just don't miss your interview. That is not recommended. :)
 
With things moving fast, there is chance to miss FP or/and interview if one is traveling. And, that will delay his/her case.

If one is confident about date(s), and someone is here to collect mail, and inform him/her in time, and s/he can travel back in short notice, s/he may travel on their own risk.

I would do Wednesday, October 14, 2009 to be on the safe side. I wouldn't date or mail the application before this date.
