Damn! Problem with new I-94\'s, will this cause AOS problems?

Hi,

This time the immigration people at LAX screwed up.
How many ways can the immigration officials screw us!!! :)

I filed my AOS just before I left for overseas.

Whilst overseas we got my new H1-B and H4 visas.
When I returned to the U.S. I got new departure
cards (I-94\'s). The immigration person stuffed up
and listed me as a H4 and my wife as a H1-B (the
opposite). The visas are perfectly correct only the
I94\'s are wrong. Furthermore, they stapled my
wife\'s I\'94 in my pass port and vice versa.

Note these are not the I94\'s that were submitted
with the AOS petition. Will this cause any problems
such as with passport stamping?

I think after filing AOS, you cannot travel until you get the 485 receipts and/or Advance Parole.

First worry about that aspect than your I-94 problem. Talk to your attorney immediately.

You can go to the nearby local INS office at any time to correct the error on your I-94. I had a similar experience. When I first came to the US, the officer at the airport screwed up my wife\'s I-94, that caused a denial of my wife\'s Social Security Number application. So I went to the local INS and explained the situation, then the officer there corrected my wife\'s I-94, no questions asked.

The rule has been changed (since 1999 or 2000) so that the 485-applicant can travel abroad with unexpired H1/H4 visa if he/she never used AP/EAD.
