slowlazygc said:I am new to this group, i read through most of the messages posted over the last few years. I saw that someone was collecting stats related to Lc's and processing times.
From the stats gathered is there a pattern after the 45 day letter. How long is it taking. I know it is not a easy guess as it is very random, but since we have some stats if there is a pattern it will be great, if we could hear a average.
Thanks in advance.

Also i have a company B which is ready to sponsor my GC without being employed by them .on future employment basis.Additionally i am on my 7th year visa extension. So can i go ahead with Company B's GC process too and join them in the last stage of GC.I am also from worldwide category so i want to take advantage of that fact and get my AP/EAD asap.Any inputs.
Sfmars can u help here.
I am glad that everyone is having a bit of fun while waiting.. again, i think sfmars contributions to this board are exemplary.. specially given the fact that he doesnt need to be looking into these queries any more. keep the hope guys.. lets see how things proceed from here..LaborNoWhere said:Many In (N)One Out.
sfmars said:In B case and adjustment of status they may require copy of pay checks and W2 forms, and I do not think it is completely legal to use second employer and use adjustment of status. I do not see problems to have second process and join them. I would do following: when your PERM is done ask them to file I-140 only without concurrent and ask them to do consular processing. When you get I-140 approved ask them to send a request to National Visa Center that they changed a decision and want to have adjustment of status now.
You will loose one month but ypu will be able to file EAD/AP in this case.
I think that EAD/AP they issue only in case of adjustment of status.
The only thing I would worry is that they may implement retrogression for EB2 category soon and you will not make it.
REMEMBER THAT AT THE BEGINNING OF 90th RETROGRESSION FOR EB2 WAS MUCH WORSE THAN FOR EB3
Chocolate said:Thanks for your input. But as far as i remember i havent seen retro for worldwide category .also i was just thinking of this option When do u think i can expect my approval(PD-May 2004 45 day letter OCt 3005 )
sfmars said:Why are you so sure that is going to be approval? It can be denial.
The probability is 50/50
Chocolate said:I am sure of an approval becoz i have an MS (CS) and 4 years experience and the job is also advertised for the same.As of now there are no denials from my company too.so i am pretty sure i will also be approved.i just wanted to know a time frame for that as i am in my 7th year and sick of being on visa and want to get ead asap.Any inputs.
sfmars said:Your own credentials will be not taken into consideration by DOL. DBEC evaluates your employer only and recruitment process for your position, and especialy why your company needs so many positions with advanced degrees.
Is your company large scientific corporation and you are scientist or you have IT position ? If your position is IT related DOL or USCIS may think that your employer's requirements for the position were not fair (MS) and your employer did them just to adjust them to your credentials.
All IT and computer science positions are EB3 from USCIS and DOL point of view. Most of us in this forum including me have MS or BS + 5 years however category is EB3 because it has more chances to come through.
