Joining company

Hi guys,

My future employment based labor was approved couple of weeks ago. Currently, I am working for another company and not sure at what stage
(140 or 485) I can join the company that processed my labor. Any information is appreciated. Thanks in advance.

my labor application "certified" cover letter has come in mail and received on 02/11/2006;
Cover letter is dated 02/07/2006.

Does your letter farwarded to your new address. .. Just want to make sure letter farwarding is working ..

How come they are still waiting? What is a reason?

Mine is Case source is State, since SWA sent my approved labor on 1-DEC-2004 to Regional..my Attorney says since it was late 2004 Regional didn;t got a chance to enter in their system...so even though went from Regional to Dallas .....still my case considered to be SWA..but I recieved my 45 days letter in June'2005.......this looks to me they treated like a regional case.....still I am waiting......hoping for best...let's see...

California SWA cases general questions

Gang:
Can a guru help me "summarize" the California SWA situation.

- approvals from my local SWA went upto about 20 days before my date (see below)
- does this not mean (and I know it doesn't) that ALL cases before Feb/04 were delt with in one way or another (approved or denied)?
- are there really thousands of CAL SWA cases from years before 2004 still out there?
- are some of them in a different "classification" - and if so, what does this mean -- to them and me?
- are these cases from a particular SWA office that was really unproductive?
- where all these cases remanded from DOL back to state? (due to layoffs in industry)
- where these cases all computer replated and due to lay-offs in early 2000s, they have been "put aside" on purpose? (I remember someone else mentioning somthing to this effect)
- what is the similarity for California cases not approved for many years?
- has anyone contacted a California senator/congress person and asked why Cal cases are so far behind the eight ball?
- does anyother state has such a significant delay issue -- Chicago (IL) seems to be great a approves -- they all appear to be going ahead of us to the next step, but they will be waiting for us and we will jump infront of them -- unless retrogression progresses, they get cleared, and then retrogression comes back before we can clear....
- any other inputs would be of interest

CA EB2 cases are super slow. Anyone'd like to speculate some reasons? It's frustrating...

Not sure about this. Ask your attorney. My understanding is to get old PD transferred to new PERM case, you need to request this at the time of PERM application specifying the details of old case and withdraw the old case. Don't know after getting PERM approval you can transfer the PD or not.
 
Wish I knew....

My lawyer and local congressman contacted DBEC and the only response was to confirm the file was in progress, 45 day reply recieved and ...you'll love this...cases are being processed in FIFO order....

My 45 day letter was issued 11 Feb 05.

PD 25 Nov 02

thats 1,177 days..3 years, 2 months, 22 days

Your lawyer is wrong.

I'm sure your lawyer is wrong. I got approval recently. My screen shot was also stated case source as STATE. But I forced my lawyer to contact DBEC and fax all the information to prove that it reached Regional. He did the same. I also faxed the same information to DBEC. After faxing the information, i got approval in two months. Do whatever you can to fix this issue. Otherwise, you might need to wait long.

Hope you are already downloaded the database and checked whether your case in there in Regional database or not. If not check there. That will give some idea.

Which documents you have faxed to Dallas Backlong Center?
Do you know how Attoeney approached to Dallas?

That database is crappy. They have NOT updated it since ages. I know several cases from that list that got approved and are close to getting final GC....

I could never find my case in that..

The fact is that we are like orphans here with no one to listen or turn to. DOL is playing a cunning trick with all of us with their repeated excuses and updates.. I guess the only way left is to GHERAO them desi style in front of their offices in Dallas and Phily. WHY cant we all rally and do that ...........

chikkili - 45DL received only 01/17/06. It is reasonable to give DBEC couple of months to make a decision
and based on the number I think that case was recently entered to their database,
Probably transfered to DBEC from SF DOL only in December 2005. WHY ARE YOU SURPRISED ?

smuppala - PD 12/10/03 , Last update from him/her was 11/16/2005. If it is RIR it should have been
approved sometime at the end of November or in December.
May be smuppala simply did not report about approval


RajWaitingonLCA - It is strange, He has very strange case number for his PD 12/31/03 D-05145-XXXXX
It was entered to the DBEC database some time at the end of May 2005 as SWA,
I believe DBEC finished entering Reginal cases at the April, and Regional from CA
at the end of February 2005 got 45DL. I would say that DBEC treats his case as SWA.
But anyway it is not very bad for him, I believe he will be certified within next 5 months anyway.


immm, RIR_CA_1001, VISLI_COM, jhegde, inneedofgc - I believe they will get decision soon,
anyway it is not time for them to be in panic now.
DBEC has finished most of CA RIR Regional cases but I think
some of them (some problematic) can certified with SWA people.


factfinder, patience13, LaborCA, june_16 - I would recommend them to get their screenshots to say something about them
each situation can be specific.

An awareness rally is being planned sometime in the first or second week of March 06 at Washington DC. Check it out at www.immigrationvoice.com.
Sign up for the rally. The bigger the crowd, the more effective it'll be. Others too pls take time to visit the site and sign up. It'll be a great effort to speed up the process. But your action is urgently required.

Hi MJEE,
I found my case in the PERM Database and it says that the case was received in the Regional Office on 08/26/2004. Whereas the screenshot last obtained in October 2005 said that the case source is "State".
MJEE, SFMARS, other experts, can you please tell me if there's anything my lawyer can do to followup with DBEC and expedite my approval? Appreciate your response.
