my wife is going to apply for H4 Stamping soon.
My I-140/485 is under processing.
what she has to say in column 36? Yes or No.

Has Anyone ever filed for Immigration Petition?

Has anyone ever filed for Immigration Petition?
------------- I-140 is the immigration petition and it is NOT filed for her it is filed for YOU by your employer, she has to write NO even if she filed derivative I-485 with your I-485
 
Ginnu, should the answer not be YES - as her 485 has been filed?
Because the question if I remember right is - Has an immigrant petition ever filed by u or by antone on ur behalf?
 
I-140 is Immigration petition
I-485 is Application to Adjust Status to permanent residence
Q36 only asks for Immigration petition (I-140) Not for Adjustment of Status or I-485 filed
 
LC is not immigration petition
I-140 is immigration petition
If only LC was filed write NO
 
How does it matter..

I have a similar case.
140/485 will be filed soon and I will be visiting India in another couple of months. Also I will have to go for VISA revalidation.
Does it matter if answer to this question is Yes?
Any one has any expereince with it?

---- If I-140 and I-485 is filed and you get I-40 and I-485 filing receipts before departure then your reply will be YES and it does not matter because H1B, H4, O visa have dual intent
Any one has any expereince with it?
