Hi, I am currently on OPT and working. My company has applied for H1 in 2008quota. If I get the H1 then it will be effective from October but I get the H1 approval in June or July. My question is, If I get the H1 approval, would I able to go to India in June or July and come back without any problem on the basis of just approval not the stamping. I am confused about this, please let me know. Thanks
 
If you leave before receiving the approval notice and were filing for H1B on the COS, the COS will be considered abandoned and you will either have to refile COS or leave to obtain H1B stamping and re-enter. You will not be able to work until you have a valid I-94.

Note: there are reports of individuals receiving approval notices in error even though their COS was invalidated . They are reporting problems because of the abandonment.

Do NOT travel while COS to H1B is in process.
