Currently in H4,advice on H1 status change

Hi,

I'm currently in H4 visa.I'm planning to apply to H1 in 2005 quota.An employer has told me that he would do the H1 for me.A posting says that if a person in H1 is without a proj / no pay stub for more that 6 months his status becomes out of status.What if GC is in progress?

Now that I'm planning to apply for H1,I'm worried about these consequences.Do I have to make sure anything while talking to the employer while doing H1?

Is there anyother option if a person does not get a proj but is in H1 visa without pay stubs? Is there a any alternative for this?

Or is it always safe to get H1 done once I get a project?

-------- if your employer apply H4 to H1 change of status you can join him once H1 is approved and he NEED to pay the wages as on LCA ( project or no project, no BENCH or table) If he cant get you project it is not your fault, he has to pay you, if he does not pay then you will be out of status. many who filed H4 to H1 and could not get the pay or job on H1 again tried to be on H4 from H1. find a employer who has job and ready to pay once you join him. dont go for H4 to H1 if that employer has to look for projects and then only is going to pay you after he can find a project for you.
