Got two cases going
case i) Current employer: EB2-RIR, PD Apr 20 2004 (very near ..but still not current). I-140 approved.
case ii) Future employer: EB2-RIR, PD Nov 20 2004. Labor approved. I-140 still not filed.
Question 1) If I file I-485 for current employer and it gets denied, do I lose the priority date of Apr 20 2004? Or would I still be able to use that the Apr 20 PD when applying i-485 for future employer
Question 2) Can I file the I-140 for future employer even though I already have an approved i-140 from current employer? Would USCIS see conflict?
Question 3) If I file I-140 for future employer and it gets approved, it will have PD of Nov 20 2004 (correct?). In that case, will I be able to use the PD of Apr 20 2004 when filing i-485 for future employer (if current employer i-485 gets rejected and future employer i-140 is already approved with PD of Nov 20 2004). This question does sound like Q1 but please read it again, its presents a different scenario.
