Current economy

One of my friends recently tried to start GC processing through his company which was willing to do that for him. But the company's attorney turned the option down saying that the economy is still weak and if there is an ADvt then there would be lots of responses which will make the situation difficult. I feel that the attorney was having RIR processing in mind when she said that but there is no way to confirm that... Is non-RIR an option for my friend? If so what are the chances that my friend would not have any problem in that? Also are there any other attorneys who see that it is still possible to do GC ? My friend works in VA.

Are there companies who still do GC for employees?

The lawyer is thinking of Non-RIR

Because thru RIR u wouldn't need to advertise as the company is already certified.

Nowadays it doesn't matter as the delays are pretty much the same, but RIR prevents the hazzles, also by the end of year, there is PERM processing which would speed up Labor [Supposedly!!!]

Not all companies are eligible to take the RIR route.

Small companies normally take the non-RIR route which is a big hassle (advertisements etc) and takes eternity to clear the LC.

Also many Big companies who have layed-off in big numbers in the recent past cannot take the RIR route.

They will not be able to prove why they need people when they are laying-off on one hand. They would have to prove that the layedoff peoples' skill set is different than the people that they will be hiring (people for whom they are sponsoring GC)

Both routes are dicey these days. Because of the economy RIR is dangerous. Non-RIR is also dangerous because many people will reply to the advertisement. However, in a non-RIR case, a good lawyer will reply to all those ad's without any problem. It is still very risky. Just to let you know that my case (advertisement)received 23 replies. All the applicants were rejected by my lawyer. I frankly dont know how they did it. (There was a subtle way they did it, but beyond the scope of this thread)

Dont take a chance here. If you can bide your time well and good, otherwise ask some lawyers/experts what they think. After all they are the experts. We are just sharing our experiences.....
