CSC Pilot still alive - WAC 04 178 XXXXX Approved !!

Last Thursday, imediately after my EAD/AP approval I noticed LUD
change on our 140/485 cases. And today morning I received an e-mail
from my attorney about receipt of the 140/485 approval notices at their offices !! No e-mails from USCIS, no further LUD change this week.

Some details:

EB2 @ CSC (Original Labor - took 28 months !!)
Employer: Small (25) US operations of a mid-size (150+) European company.
ND: 06/09/2004 (140/485/EAD/AP)
FP: Done on 07/24/2004 (Received two sets of FP notices, went for the
earlier one)
EAD/AP: Approved on 08/10/04 and 08/13/04
LUD on 485: 06/14 -> 07/30 -> 08/19

I was forgetting to mention something important !

I think the recent activity (including things like this pilot program at CSC) at
USCIS and all these approvals we are seeing
is a direct result of the fight against 485 backlog put together by Mr. Rajiv Khanna and all the determined people on this forum. Kudos to you all !!!

Congrats

its good to know the pilot program is alive. my 140 was filed on 5/24 and 485 on 6/25. my wac is wac04169-xxxxx. am hoping mine would be picked up thru the pilot as well...

got my ap,ead on 7/25 and did fp on 8/1.

am a little confused to see that your wac is 04178-xxxxx and mine was submitted after you and has a lower number...
 
what is LUD

Could any one tell us what is LUD.

based on the email thread - does that mean his 485 got approved.

what about 140?

(i have a question - Does the Finger printing letter come to employee /employer /attorney ? I am yet to receive mine - filed concurrent in April 2004 VSC)

Question: Why did your lawyer receive the notice? Did the forms have the lawyer's address on them?

I thought the approval notices were mailed directly to the individuals.

Also, what did the LUD say on your I-140/I-1485 status after FP? Did it mention 90 days or 360 days?

I might have received the approval notices, but I'll know for sure only after
collecting my mail which is currently on hold.

I think 1-140 original approval will be with my lawyer and I'll receive a courtesy copy. And may be other way round for the 485 approval notices.

I have taken an InfoPass appoinment (one for myself and another for my wife)
for next wednesday.

I'll post further details next week.

For I-140 : current status says

Your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received on June 9, 2004. We mailed you a receipt with information about processing. It istaking between 360 and 360 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

For our 485s it says -

On July 30, 2004, the results of your fingerprint review for your I485 Application to Register Permanent Residence or to Adjust Status were received, and processing has resumed on your case. We will mail you a notice if further action is needed, or when a decision is made.

mine is 04170XXXXX , may i should check with my lawyer, mine 140 was received on May27th itself. I heard that these Pilot programs are lottery based , is it true ?

Since you did not recieve any emails from INS, did you check the online status of your 140/485 ? Are they still in Pending status or do they show an approved Status ?

I am very curious because my LUD changed to 8/24 on my 140/485 and on my EAD/AP even though they have been approved earlier. My case is 2 days later than yours (ND 6/11). I assumed that they had either sent an RFE or had approved it !!

Could you please tell me what you mean by LUD? How can I check the status of my case using my WAC number? Is it different from the case status online page at www.immigration.gov?

Please let me know.

There is a good chance that your case has been approved.

As of last friday:
My phone status for I-140 is unavailable/missing
and that for 1-485 is "On July 30th we received the review of your fingerprints..." etc. etc.

Also my online status still says processing resumed for 485s. No change
on I-140 either.

Itshuman, I have no idea about pilot program using some kind of lottery
system. All I can guess is that they are picking up (giving priority to) the most
straight forward cases and are approving those within 90 days.

I collected my on-hold mail today and found the courtesy copies of our I-485 approval notices and now I believe that I am really 'approved' :). (And I am least bothered about my online status etc.)

I'll be going for the stamping this Wednesday. So more later.

Stamping experience and good bye !

We got our passports stamped on Sep 01 (Last Wednesday).

Appointment time: 11:45 AM
Reached the center at 11:35 AM
Entered thru' security and collected our token (D530) at counter # 3
Waited for 1 hour and then were called at counter # 3 and were told that
someone will immediately take care of our stamping.
Within 5 minutes our number was called at counter # 10.
It took the IIOfficer about 25 minutes to complete the stamping for both myself and my wife.

We had two different appointments but only one of those was used and we went together to the same IIOfficer.

We consider ourselves extremely lucky for having our approvals within 70 days
and I want to convey my heartiest wishes to everyone for their speedy approvals and completion of immigration process.

Here is a brief outline of our 'immigration' past:

- Entered US in Sep 1996
- Started my third job with a decent bay-area based consulting company (A)
in Dec 1997
- company A filed labor certification in last quarter of 1999
- Labor certification ( company A) approval in First quarter of 2000
- I-140 (EB3) approval (company A) received by end of 2000
- Client company (B) made an offer in Dec 2000
- Company B made it clear that I cannot continue as contractor all the way
till my 485 processing gets done, which might have taken another year.
- Negotiated with company B for sponsorship of GC and sponsoring of H1/L1
in case I had to leave US after completing 6 years and not getting further
H1 extensions.

- Left company A and joined company B on H1 in June 2001

At this point I pretty much knew that my chances of getting a GC were
diminishing.
But the job market at that time and the knowledge about strong position
of company B even during bad economy led me to leave my current GC
processing with company A and join company B.
(The AC21 was not a 'law' at that time, late 2000-early 2001 !)

- Aug 2001: Labor certification started by company B
- Aug 2002: Labor certification case sent to Federal level
- Sep 2002: Got an H1 extension (7th year) based on approved labor/140
from previous employer (A)
- Aug 2003: Labor certification was sent back from DOL (region) to state
level for revalidation.
- Sep 2003: Got an H1 extension (8th year) based on pending labor
certification application from employer B
- Dec 2003: MIRACLE happened, came to know from attorney that she
has received my labor certification.
(Later on learned that that had to do with the lobbying done by AILA
against the auto-remand procedure used by California region DOL office.
My case was sent back to Federal level from state and was immediately
approved)

- Jan Feb March 2004: family visits to India, lawyer recommneded to file
for 140/485 together for me and my wife after our arrival in US from india
Trip. Had no clue whatsoever about this CSC pilot program.

- March 2004: After coming back from india I read about this pilot program !
Started working on putting together things for 140/485 applications.

- June 2004: Our lawyer finally sent the applications (EB2) to CSC

- July 2004: Fingerprinting done on 24th July
- Aug 2004: Received EAD/AP approvals on Aug 10 / Aug 13th

23rd Aug 2004: Learned from our lawyer about the 140/485 approvals !!!

1st Sep 2004: Stamping done at San Jose

Now hoping to receive the cards before end of October 2004.

As you folks might already have noticed that there is a gap of 5 months
between my labor approal and 140/485 application. That is the purest luck !!
:) :) And I must thank my family for making us visit them during that time frame which delayed our 140/485 applications and made them fall in the pilot
program.

Thanks Manya, I think my case was updated because I changed my address, so thats why the LUD changed on all my cases. If it changes the next time, I will probably get excited.
 
LUD update

Thanks Manya! My case was submitted a couple weeks after you. Hopefully it will be processed very quickly. Cross my fingers :) By the way, the LUD of my i-140 & i-485 was changed to 08/24/2004, however, no status update. Does mean they are currently processing my case?

We seem to have very similar dates.....Did u have a LUD change on yoour 140/485 on 8/24. I had the same LUD change date too......I assumed it was because I changed my address. Did you change your address too or was it some other reason for the LUD change ?
