Hi, Sbabunle!

My I-140 was filed some 80 days later: Jan. 20, '04.
(Since then, my I-485 was filed June 15, '04, and my EAD/AP are already approved, and my FP was done July 22, '04)

My case was filed in the EB-2 category. I understand that current practice is to adjudicate I-485 Petitions alongwith the I-140, in light of the Ohata Memo - atleast for EB2 cases.
Can I therefore expect adjudication/approval (I-140 alone, if not also the I-485), in 3 months' time?

Thanks!

I hope some gurus will answer you my friend.
I spoke to my attorney today and he said that
the adjudication of I140 at the time of I485 is not
going to work. Because current 485 is more than 2 years
and people cannot use AC21. He is saying that there should
be a move to withdraw that memo. I hope your I140 will get
cleared soon
But I dont quite understand that if u filed in Concurrent or
separate. Could u post your exact RD & ND etc.
sbabu.

My case details

Thank you for replying. I filed 'semi-concurrently' under the EB-2 category at the CSC, and my case details are as follows:
I-140 RD: Jan. 20, '04
I-485 RD June 15, '04
EAD/AP AD: July 15, '04
FP: July 22, '04
LUD (FP results rec'd): July 27, '04

(As far as my I-485 is concerned, I will reach the 180-day deadline on Dec. 15. I hope that my I-140 will be approved by then - so that I can change employers, if required)

Hello There

Thanks for sharing info..
I'm working on things to file my case concurrently.
EB2. Possibly by sept last it will be in file. Lets see.
Come back check status and post update buddy.
Wish you all the best. Hope u will get 140 soon
and AC21 portability. I know this wait is unbearable
and many things are illogical. But its the way things
work. Good luck buddy.
thx
