wowo485: it seems like you have gotten your 485 approved. Congrats. Name check problem is hard to find out, I sent email, letter to FBI but no reply so far.

RFE Received

I received an RFE on my I140 app on 4/11/05.

It is for Ability to Pay and Credential Evaluation. Lawyers will be responding in the next couple of weeks.

I do not know what is happening to my case . Both 140 and 485 are pending.

Lawyer has initiated a query . Says it takes ~3 weeks to get a reply.

It has been quiet for a while for Sep cases.

Any approvals recently? Many Nov ones approved, really curious how the USCIS officers handle the cases.

My lawyer got a reply from INS saying name check is pending. I don't undertsand why my I-140 is pending becoz of name check . I thought name check is only required for I-485.

Any clues ???

I am extremely happy to inform that my I140/485 has been approved :D :D :D

I have been waiting for 5 years for this day. The wait has been painful but in the end it seems worth the wait.

Just received emails that my I-140 and I-1485 (including my wife's) have been cleared ...A long wait of 3.5 years !!!

Both my 140 and 485 were pending due to security/name checks. Had my lawyer send a request last week to separate them out.

What do u mean about "separate them out"?
Did your lawyer's request help on your I-485 approval?

My I-485 is stuck with naming check too.
My recieve day is September, 2004.

Separate out ...

My I-140 and I-1485 were filed under the cuncurrent+pilot program in Sept. 2004. Both were stuck due to name check . But the name check is only needed for I-485. So we requested the USCIS to separately adjudicate I-140 and I-1485 so that name check will only hold the I-485 and I-140 can be approved quickly.
