Cross Chargeability

Friend of mine have a problem with Cross Chargeability of I-485 Application. Here are the details.

He is from retrogation country applied for I-485 this march (EB1) and his wife is from non-retrogation country. While applying I-485, he forgot to mention Cross Chargeability on the cover ( That time he never expect EB1 will retrogate).

Is there any way now he can open the case and ask USCIS to charge for his wife country quota.

same boat...

I filed my 485 on 10/29/2003 - EB3. Now I want to request "CC" since my wife was born in Sri Lanka. I don't know what to do now? If I request will it work or not? ??Any advise.

I am in the same boat. I am from India (EB-3 PD Dec, 2001) and spouse is from non-retrogation country. The law firm handling the case informed AILA liaison at Nebraska service center and asked them to do whatever is necessary to amend my case.

my lawyer said people will seek "CC" when retrogressed significantly. I have been waiting for other countries to become current. After that I'm going to request "CC" since my wife was born in Sri Lanka. Ask your friend to send support docs. now.

I met my lawyer today. She is going to send a letter to them after other countries date become Sept' 2002 (that's my PD). So you also do the same. Do not request now. Wait until your PD becomes current then send a letter thro' your lawyer.
If you submitted your birth certificate and if it is clear enough, no supporting docs. required. Just the letter is enough. If you send it now and there is no visa numbers available, it is going make your case complicated. That's what my lawyer said when I asked her to request "CC" now.

Why do you want to wait....do you or your lawyer believe that India (if you are an indian citizen) will beat rest of the world when it comes to the priority dates? It is highly unlikely that india will beat rest of the world (specially EB-3) ever with so many desi's coming to U.S. They are expecting no movement in PD's after 1'st Qtr. of 2006.

I went ahead and applied my CC.

RamFan, I have been waiting for "other countries" to become Sept 2002 (Sri Lanka, where my wife was born). Now it is March 2001, hopefully it should cross 2002. Because if i request "CC" now, it will be meaningless, since both are retrogressed.

Is birth certificate of primary and his wife along with letter is enough to consider "CC" ?.
What to mention in the letter (Sample format)?

they already have birth certificate, which you send while filing 485. Just a cover letter is enough.
 
Did anybody got approve after applying "Cross Chargeability" from retrogated countries?

Its been a while and I am watching this thread but have not noticed if anybody was succesful. Has anybody seen approvals? How long does it take to process once the numbers are available.

Here is my dilemma- My PD is 16 April 01. My lawyer is asking extra fee for this ( Lawyers :( I know). If is going to take same amount of time with cc then why bother ?? Please post your opinion/comments.

I hope you have already paid a lot to your lawyer. Then why again? To reqest CC, all he need to do is, just send a letter to USCIS and ask them to consider this case using CC. Anyway if it is few bucks throw it.......

No my friend, I'd throw if it was few bucks, He is asking for $1K !!, I know it is not justified, but what else you can do. I'd like others members to post if they paid any fee to their lawyers. Also if someone can help me out with the documentation/refrences I'd appreciate. I can just prepare the letter myslef and ask lawyers paralegal to send it to USCIS. Thanks in advance
 
Include birth certificates of you both and copy of I-485 notices along with request letter.
