Criminal record of wife..

I am eligibile to apply for citizenship on the grounds of 3 year marriage (-90 day of course). My concern is regarding the criminal record of my wife.
I got my GC from the employer in April 2001 and was wondering if I should wait until that time is due so that I can exclude my wife from the application process.

AFAIK, if I try to get the citizenship through wife, then she will have to disclose the assault charge against me in the hearing and that might raise some concerns or even ground for denial on my application...

What do you think about this?
 
Since you are not the party who committed an offense, there should be no problem. The application asks for your spouse's name & details about kids and previous marriages. So you cannot exclude her name from your application process.

If your wife had an assault charge against you, why would that count as a crimial record against her ?!?!
Unless, of course, the charge was false and she was charged for making a false complaint.

If the charge were "true", then you would be the one having a possible record ?

Not sure what you meant anyways.

Which one of you committed the crime of assault, you or your USC wife?
 
Once you have criminal record then it has to be disclosed however way you apply: after 3 years or five years.

I know it sounds strange but it was my wife who assaulted me, not the other way around. She was charged with felony but was let go by the court as this was a first crime she ever commited.
